L'Ordre 36/2026 defineix les funcions dels funcionaris d'Habitatge, Territori i Mobilitat

The Minister of Housing, Territory and Mobility, José Luis Mateo Hernández, has approved Order 36/2026, of October 7, which establishes the functions of the job positions of the civil servant personnel assigned to this ministry and its hierarchical structure. The provision is published in the Official Gazette of the Balearic Islands (BOIB) no. 128, of October 10, 2026, and enters into force the day after its publication.

The order is issued under article 34.3 of Law 3/2007, of March 27, on the public service of the Autonomous Community of the Balearic Islands, which attributes to each minister the determination of the functions of the positions assigned to their department, with the prior report of the competent body in matters of public service. It also develops article 8.3 of Law 3/2003, of March 26, on the legal regime of the autonomous Administration, and complies with Instruction 1/2012, of February 28, of the Director General of Public Service, Public Administrations and Quality of Services.

The ministry was created by Decree 7/2025, of July 11, amending Decree 8/2023, of July 10, and its basic organic structure comes from Decree 10/2025, of July 14. The order affects only the job positions economically funded in the budgets.

Five management centers and territorial scope

Annex 1 describes the functions of each job position and Annex 2 establishes the organic structure. The ministry is organized into five management centers:

  • General Secretariat
  • Directorate General of Housing and Architecture
  • Directorate General of Mobility
  • Directorate General of Territory and Landscape
  • Directorate General of Urban Harmonization and Environmental Assessment

The structure includes units in Palma, Ibiza and Menorca, in addition to the Mallorca Transport Consortium. Among the described positions are personal secretaries, drivers, architects, senior technicians, environmental inspectors, transport inspectors, project and mobility engineers, instructors, and administrative and auxiliary staff.

Data protection and authentic copies

Regardless of the specific functions of each position, the order generically assigns collaboration tasks regarding personal data protection and the National Security Framework to:

  • Department heads and service heads, and assimilated positions with a destination supplement (CD) 26 or higher.
  • Section heads, and assimilated positions of group A1/A2 with CD 25 and A2/C1 with CD 23 or higher.
  • Office heads, and assimilated positions A1/A2 with CD 23 or higher and C1/C2 with CD 17 or higher.
  • Base positions and non-hierarchical positions.

The locations authorized to issue certified copies of documents from the files of their unit are also determined, without prejudice to the functions of the registry assistance offices (OAMR). Hierarchical positions assume the generic functions of point II fourth of Instruction 1/2012, and it is the responsibility of the heads of service and department to direct, coordinate, and supervise the work rhythms and the presence of personnel to control compliance with the workday and schedule.

Substitutions and repealed regulations

In the event of a vacancy or absence of the holder of a head of department or service, their functions shall be assumed by the head designated by the governing body to which the position is assigned. For the remaining positions, they shall be assumed by the immediate hierarchical superior according to annex 2.

The order repeals:

  • The Order of the Minister of Housing, Territory and Mobility of September 21, 2026, published in BOIB no. 120, of September 24, 2026 (edict 9517).
  • Order 27/2024, of July 26, 2024, published in BOIB no. 101, of August 1, 2024 (edict 7608).
  • Any other provision of equal or lower rank that contradicts what is established by the new regulation.

The regulation updates the functions map of a department created just over a year ago and specifies who does what regarding housing, territory, mobility, and environmental assessment. For the public employees of the ministry, it determines their tasks, the substitution regime, and data protection responsibilities; for citizens, it specifies which units process urban planning, housing, transport, and environmental authorization files.
