Por FactBox Admin

The Decentralized Municipal Entity of L’Estartit has approved the provisional award of municipal authorizations for the municipality’s non-sedentary market, with 59 stalls assigned and 33 remaining vacant. The decision is contained in presidency decree no. 834/2026, of September 22, signed by president Genís Dalmau i Burgués, and was published in the Official Gazette of the Province of Girona no. 190, of October 2, 2026 (CVE BOP-2026_0_190_8399). The administrative file is X2025000828.
The procedure is governed by the L’Estartit Market Regulations and by the regulatory bases of the public offer of municipal authorizations, and is developed in accordance with Law 18/2017, of August 1, on trade, services and fairs; Decree 162/2015, of July 14, on sedentary sales in merchants’ markets, and Legislative Decree 3/2010, of October 5.
The background dates back to the provisional list of admitted, amendable, and excluded requests, published in BOP no. 212, of November 6, 2025, which opened a period of 10 business days to amend requests or justify the alleged merits. The Evaluation Commission was appointed by presidency decree no. 2026-184, of March 6, 2026, and issued minutes on March 10; the proposed resolution is dated March 12, 2026, with reports from the Territory Promotion Technician on March 5 and 10.

(A10) and JOSEP M. HOSTENCH FONTBERNAT (A11).
Ten business days to submit documentation
Provisional awardees must submit the following documentation within a period of 10 business days starting from the day after the publication of the decree in the BOP and on the corporation’s notice board:
- Certified copy of the DNI, or deed of incorporation and appointment of administrator in the case of a legal entity, including the company’s CIF and the administrator’s DNI.
- Certificate from the State Tax Administration Agency proving that all tax obligations are up to date.
- Social Security registration of the holder and their employees, and a Social Security certificate proving that payments are up to date.
- A passport-sized photograph of the stall holder and the workers, and a copy of the employment contract.
- Registration in the corresponding heading of the IAE (Economic Activities Tax) and accreditation of being up to date with the fee.
- Current policy and receipt of the civil liability insurance for the stall, with a minimum coverage of 300,000 euros.
Failure to submit the documentation within the deadline is considered a waiver and leaves the spot vacant; furthermore, anyone who does not comply with the requirement will not be able to participate in any other competition for the non-sedentary sales market of L’Estartit for 2 years.
Provisional pool, dismissals and deserted stalls
Once the deadline has closed, the remaining vacant spots will be filled using the pool list. The resolution creates a provisional pool with 59 interested parties, headed by OMAR EL KABDANI EL BAKKAOUI (stall 7, 66 points) and IRENE SANTOS DE PUIG (stall 3, 65 points). Once the final list of awarded and vacant stalls is available, the interested parties will be summoned to the EMD offices, at Carrer del Port, 25, L’Estartit, in order of score.
The resolution also dismisses 42 applications, mostly for not reaching the minimum required score, for inaccurate or false documentation, for failure to pay fees, or for submission after the deadline. Likewise, it provisionally declares 33 stalls deserted, including numbers 1, 4, 12, 17, 18, 19, 21, 22, 26, 27, 28, 32, 33, 34, 39, 42, 44, 47, 48, 51, 52, 57, 58, 61, 62, 67, 72, 78 and 79, and stalls A2, A4, A6 and A9.
The publication provides the municipality’s stallholders with the definitive framework for the season and opens a tight calendar of ten business days to formalize the stalls, with the pool as a mechanism to cover vacancies and prevent spots in the market from remaining empty.
