Justice Ministry appoints Giribaldi Bertrán as director of PRONABI

The Ministry of Justice and Human Rights appointed Javier Enrique Jesús Cayetano Giribaldi Bertrán as director of the National Program for Seized Assets (PRONABI), a key trust position in the administration of assets confiscated from organized crime. The decision was adopted through Ministerial Resolution No. 349-2026-JUS, signed by Minister Ernesto Álvarez Miranda and published in the Legal Norms supplement of the official newspaper El Peruano on Monday, September 14, 2026.

The regulation, dated in Lima on September 11, 2026, was issued upon confirming that the position of director of PRONABI was vacant. In the same act, Giribaldi Bertrán was assigned, in addition to his duties, the Executive Coordination of the program, the unit responsible for the operational and administrative actions that exercise the legal representation of the organization.

A strategic position against organized crime

PRONABI was created by Supreme Decree No. 011-2017-JUS for the purpose of receiving, registering, qualifying, safeguarding, securing, preserving, administering, leasing, assigning for temporary or definitive use, and managing the disposal and sale at public auction of assets seized in asset forfeiture proceedings. Its work is central to depriving criminal organizations of illicitly obtained assets.

The appointment is based on the PRONABI Operations Manual, approved by Ministerial Resolution No. 164-2026-JUS on April 24, 2026, which includes the Executive Coordination within its functional structure. The applied regulatory framework includes:

• Law No. 29158, Organic Law of the Executive Branch.
• Law No. 27594, which regulates the participation of the Executive Branch in the appointment and designation of public officials.
• Law No. 29809, Law of Organization and Functions of the Ministry of Justice and Human Rights.
• Law No. 31419 and its regulation, approved by Supreme Decree No. 053-2022-PCM, regarding suitability for access to public office.
• Supreme Decree No. 013-2017-JUS, Regulation of Organization and Functions of the sector.

Scope of the appointment

According to the resolution, Giribaldi Bertrán assumes the trust position of director of PRONABI and, additionally, the functions of Executive Coordinator, with the aim of guaranteeing the continuity of the program’s functions. The Entity’s Position Table of the Ministry of Justice, approved by Executive Presidency Resolution No. 000205-2025-SERVIR-PE on December 22, 2025, expressly includes the position of director of PRONABI.

The measure reinforces the program’s institutional framework within a context of fighting money laundering and organized crime, in which PRONABI acts alongside the Financial Intelligence Unit of Peru (UIF-Perú), SUNARP, the PNP, SUNAT, and the Public Prosecutor’s Office in the recovery of illicit assets.
