Justicia asciende a dos abogadas a Procurador A en la Procuraduría General

The Executive Branch has appointed Maripaz de la Torre Herrera and Evelyn Illiana de la Hernández Kelly to the position of Procurador A (Attorney A) in the Procuraduría General de la República (Attorney General’s Office) on an interim basis. The decision is detailed in Executive Agreement AMJP 180-07-2026, published in Supplement No. 132 of the Official Gazette La Gaceta No. 186 on Friday, October 2, 2026, within the agreements section of the Ministry of Justice and Peace. Both promotions are effective as of July 9, 2026.

The agreement was signed on July 23, 2026, at the Presidency of the Republic and is based on articles 140 paragraph 2) and 146 of the Political Constitution, article 28 paragraph 2, subparagraph b, of the General Law of Public Administration, and article 18 of the Organic Law of the Attorney General’s Office, No. 6815 of September 27, 1982.

The first recital of the agreement recalls that article 18 stipulates that employees of the Procuraduría General de la República are appointed via an agreement published in the newspaper La Gaceta. The second invokes article 2 of the Civil Service Statute, Law No. 1581 of May 30, 1953, according to which workers in the service of the Executive Branch remunerated by the treasury must be appointed by a formal agreement published in the Official Gazette.

The two promotions

  • Maripaz de la Torre Herrera, identity card No. 1-1640-0926: moves from Civil Service Professional 2, position No. 377086, budget code No. 214-79100-01-0001, to Procurador A, position No. 361304, budget code No. 214-791-00-01-0001.
  • Evelyn Illiana de la Hernández Kelly, identity card No. 1-0764-0296: moves from Civil Service Professional 3, position No. 105315, budget code No. 214-791-00-01-0003, to Procurador A, position No. 046226, budget code No. 214-791-00-010004.
  • Both positions correspond to the specialty of Law and were authorized via official letter MH-STAP-ACDO-0694-2026 dated June 23, 2026.

Delegated signatures

The agreement does not bear the direct signatures of the heads of the institutions. It is signed by Alexander Astorga Monge, Director of the Office of the Presidency of the Republic, by delegation of President Laura Fernández Delgado, authorized via Agreement No. 040-P of July 14, 2026, published in La Gaceta No. 133, Supplement No. 91 of July 17, 2026.

On behalf of the Ministry of Justice and Peace, it is signed by the Vice Minister of Strategic Management Sandra Rodríguez Chaves, representing Minister Gabriel Aguilar Vargas, according to the delegation established in agreement AMJP-0143-05-2026 of May 21, 2026, published in Digital Supplement No. 64 to La Gaceta No. 97 of May 28, 2026.

Validity and scope

Article 3 of Executive Agreement AMJP 180-07-2026 establishes that the regulation takes effect from the dates indicated in the previous articles, namely, July 9, 2026, for both promotions. The publication was made in Supplement No. 132 to La Gaceta No. 186, 703-page edition.

The appointments are interim in nature, a figure that allows positions to be filled without granting tenure in the post, and are formalized in specialty positions in Law within the Civil Service regime.

Publication in the Official Gazette is the requirement that gives efficacy to the appointment: without it, the promotions are not considered formalized for the purposes of the Civil Service Statute. The process is completed with the certificate from the National Printing Office, which certifies the electronic issuance of the October 2, 2026 edition.
