Justice increases the budget for the Gandia Palace of Justice by 273,549 euros

The Department of Justice, Transparency and Participation has increased by 273,549.75 euros the delegation of powers to the Gandia City Council for the contracting, tendering, awarding, and execution of the construction work for the city’s Palace of Justice, bringing the maximum limit of the delegation to 21,959,729.14 euros. The decision was signed by the regional minister Nuria Martínez Sanchis on September 17, 2026, and published in the Official Gazette of the Generalitat Valenciana (DOGV) no. 10459, of September 25, 2026, section III, with the official reference DOGV-C-2026-30195. The delegation file is 02/DC/18/DGJ/02.

The accounting adjustment of the delegation

The resolution modifies the current delegation of powers, whose maximum amount was 21,686,179.39 euros, established by the Resolution of April 3, 2023, of the Department of Justice, Interior and Public Administration (DOGV 9573, of 13.04.2023). According to the official text, the approved increase seeks to “accountingly adjust” the limits established at the time to the actual execution of the work and guarantee the financial balance of the receiving entity.

The starting point is as follows:

• Current maximum amount of the delegation: 21,686,179.39 euros.
• Expenses already paid and settled to the Gandia City Council: 20,192,707.48 euros.
• Available amount before the modification: 1,493,471.91 euros.
• Estimated pending obligations: 1,767,021.66 euros.
• New maximum limit after the increase: 21,959,729.14 euros.

The department emphasizes that the increase in the contract price “in no case is attributable to the management of the Gandia City Council.”

Credit for the 2026, 2027, and 2028 annual installments

The second resolution authorizes and allocates a credit of 1,767,021.66 euros to cover pending expenses, charged to chapter 7, program 141A00 of Justice Administration, application G01070201.141A00.7, line T0097 («Finançament delegació de competències per a la construcció d’infraestructures en matèria d’administració de justícia»). The approved distribution is:

• Fiscal year 2026: 1,737,800.20 euros.
• Fiscal year 2028: 29,221.46 euros.

The pending payments are divided between the final work certification, amounting to 1,510,063.53 euros, already approved and recognized by the council, and the extraordinary price review no. 3, estimated by the city council at 227,736.67 euros. To this is added a difference of 29,221.46 euros from the service contract, corresponding to the third phase of the contract (5% of the award amount), linked to the four-year guarantee period from the work reception act, formalized on September 25, 2024; therefore, its execution is planned for 2028.

Background of the work and the contracts

The original delegation dates back to the Resolution of September 17, 2018, from the Regional Minister of Justice, Public Administration, Democratic Reforms, and Public Liberties (DOGV 8471, of 01.24.2019). The subsequent economic milestones are as follows:

• Administrative works contract 2023-0044 (CONT-016/2021), formalized on May 12, 2023, for 18,145,315.88 euros, VAT included.
• Services contract CONT-032/2019, modified by the Resolution of the Gandia City Council 2023-6537, of August 2, 2023, with an increase of 97,405.00 euros and a total of 584,430.00 euros; contract 2023-0073 was formalized on August 11, 2023.
• Extraordinary price revision no. 1, recognized by Decree 2023-8375, of October 19, 2023, for 666,343.88 euros, VAT included.
• Extraordinary price revision no. 2, requested by Taller de Construcción TMR, SA and recognized by Decree 2024-2158, of March 22, 2024, for 817,897.91 euros, VAT included.
• Final work certification (May 2025), approved by Decree 2025-5070, of June 17, 2025, for 1,510,063.53 euros, VAT included.

The file is completed with reports from the Judicial Infrastructure Projects Service (December 15, 2025), the General Directorate of Justice and Self-Government (December 16, 2025, and May 22, 2026), the Generalitat’s Legal Counsel (January 28, 2026), and the Comptroller’s Office (April 16, 2026). The municipal request for the modification of the economic allocation was registered on October 21, 2025.

Impact for Gandia and the construction companies

The operation unlocks the payment of the certifications and price revisions that remained pending for the work, which had already been conditionally accepted in September 2024, and provides budgetary coverage until 2028. For the city, it consolidates the financing of a key judicial infrastructure; for the companies involved in the works and project management contracts, it guarantees the collection of the recognized amounts and the 5% retained until the end of the warranty period.
