Andalusian Regional Government initiates forced expropriation for power line in Jaén

The Territorial Delegation of Economy, Finance, European Funds, and Industry, Energy and Mining in Jaén has published in the BOP of Jaén the notice initiating the procedure for compulsory expropriation of a group of rural properties affected by the medium-voltage overhead power line of the project called “Arroyo_Oja” (file AT 227/2016-2). The document, registered as notice 2026/3555, appeared on Tuesday, 18 August 2026, in issue number 159 of the provincial bulletin, on pages 12803 to 12807.
The agreement, signed by the Territorial Delegate Javier Calvente Gallego in Jaén on 16 July 2026, summons the drawing up of minutes prior to occupation —and, where applicable, definitive occupation— of the assets and rights affected by the electrical installation. The scheduled date is 7 October 2026, and owners must attend the headquarters of the town councils of the two municipalities involved.
Legal framework of the project
The expropriation is based on the Declaration of Public Utility granted to E-Distribución Redes Digitales, S.L.U. (Tax ID B82846817) by Resolution of the same Territorial Delegation of 17 May 2024, published in the BOE number 165 of 8 July 2026. That resolution simultaneously granted the Prior Administrative Authorisation, the Construction Authorisation and the Declaration of Public Utility for a new medium-voltage overhead power line outlet of 25 kV, single circuit, which will start from the “Génave_Renovables” substation, located in the “Casa Blanca” area.
Law 24/2013, of 26 December, on the Electricity Sector (Article 56) and Royal Decree 1955/2000 (Article 149) support the declaration of public utility, while Article 52 of the Compulsory Expropriation Law enables urgent occupation. The expropriation procedure falls entirely under the jurisdiction of the Territorial Delegation of Jaén, in accordance with Articles 56 and following of the Compulsory Expropriation Regulations approved by Decree of 26 April 1957.
Properties and owners affected in Puente de Génave and Arroyo del Ojanco
The Annex to the notice details some thirty properties distributed between the two Jaén municipalities, whose owners include both natural persons and agricultural and olive-oil entities:
- El Puente, Aceites y Subproductos, S.L. — farm in Plot 357, Polygon 1, Puente de Génave.
- Hermanos de Martínez Ruiz, Juan — two farms (plots 220 and 219) in Puente de Génave.
- Agropecuaria Guadalmena, S.L. — farm in plot 219 in Puente de Génave.
- Linares Gutiérrez, Juan — three farms (plots 210, 211 and 207) in Puente de Génave, with the largest canopy areas along the route.
- CB Pedro y Ramón Ruiz Avilés — three farms (plots 206, 310 and 66) in Puente de Génave.
- González Ortega, Emilio — eight farms in Puente de Génave (plots 91, 92, 93, 69, 68, 291, 309 and others), most with line supports.
- Martínez García, María Dolores — farm in plot 90 in Puente de Génave.
- Soria Bustamante, Domingo — three farms (plots 94, 95 and 96) in Puente de Génave.
- Niño Fernández, Eladio — two farms in Arroyo del Ojanco (plots 60 and 61).
- Martínez Jiménez, Blas — farm in plot 950 in Arroyo del Ojanco, with support.
- Hermanos de Martínez Ruiz, Rufina and García Sánchez, Martín — farm in plot 339 in Arroyo del Ojanco.
- Prior Esteo, Ana María — farm in plot 77 in Puente de Génave.
- Valiente Lainez, Santiago, Hermanos de Herrera Moreno, Antonio and Vela Hernández, Ramona — shared farm in plot 59 in Arroyo del Ojanco.
The route includes up to 15 supports (towers or poles) distributed across both municipal districts, with temporary occupation areas ranging from 23 to 3,725 m² depending on the farm.
Day, location and required documentation for attendance
The drawing up of records will take place on 7 October 2026 at two simultaneous venues, with staggered schedules by owner:
- Excmo. Ayuntamiento de Puente de Génave, Avenida de Andalucía, 11 — for farms in the municipality of Puente de Génave, with sessions scheduled between 12:30 and 18:00.
- Excmo. Ayuntamiento de Arroyo del Ojanco, Ctra. Córdoba-Valencia, 125 — for farms in the municipality of Arroyo del Ojanco, with sessions between 10:00 and 11:00.
Interested parties must attend in person or through an authorised representative, providing documents proving ownership (property deed or simple registry note) together with the latest Property Tax receipt. In the case of tenancy, the corresponding contract will be required; in the case of succession, inheritance documentation and tax settlement forms. Owners may be accompanied by an expert surveyor and a notary, at their own expense.
In the event of absence, the company E-Distribución Redes Digitales, S.L.U. —with notification address at C/ Ribera del Loira, 60, CP 28042, Madrid— shall act as the beneficiary entity and the fair compensation shall be deposited with the Caja General de Depósitos of the Regional Ministry of Economy, Finance and European Funds. The notice shall also be published in the BOE, the newspapers Ideal and Diario Jaén, and the official notice boards of both town councils, in accordance with Article 44 of Law 39/2015, on the Common Administrative Procedure.
Relevance for farmers in the region
The expropriation directly affects more than twenty plots of agricultural and olive-growing use in the heart of the Sierra de Segura, one of the areas of greatest productive weight in the province of Jaén. The hearing on 7 October is the last opportunity for owners to submit allegations regarding possible errors in the list of affected assets (Article 56.2 of the Expropriation Regulations) and to make claims against third parties with better rights, so attendance with all land registry and tax documentation in order is recommended.
