José Luis García-Juanes, new chief prosecutor of Madrid

The Council of Ministers, in its meeting on August 25, 2026, has agreed to appoint José Luis García-Juanes Guerrero as chief prosecutor of the Provincial Prosecutor’s Office of Madrid, one of the most relevant positions within the Public Prosecutor’s Office due to the volume of cases it handles. The appointment is formalized through Royal Decree 696/2026, of August 26, published in the Official State Gazette number 211, of August 27, 2026, in section II.A (official reference BOE-A-2026-18212).

The decision was adopted upon the proposal of the Minister of the Presidency, Justice and Relations with the Courts, Félix Bolaños García, following the formulation of the Attorney General of the State and after the meeting of the Fiscal Council. The decree, signed by King Felipe VI and countersigned by the minister, is issued in accordance with articles 36.1 and 38.1 of Law 50/1981, of December 30, which regulates the Organic Statute of the Public Prosecutor’s Office, and articles 50.1 and 55.3 of the Regulations of the Public Prosecutor’s Office, approved by Royal Decree 305/2022, of May 3.

A prosecutor with a long career in Madrid

José Luis García-Juanes Guerrero, born on June 16, 1964, already appeared in the General Scale of the Prosecutorial Career published in 2021 as a prosecutor of the Provincial Prosecutor’s Office of Madrid, a post in which he had accumulated an extensive career. His promotion to the leadership of the Madrid prosecutor’s office places him at the head of one of the largest staffs and highest workloads in the country.

The Provincial Prosecutor’s Office of Madrid is the largest in Spain by number of prosecutors and cases, and its chief coordinates the actions of the Public Prosecutor’s Office in the courts and tribunals of the province, including the major proceedings of the capital.

A regulated procedure

The appointment follows the procedure provided for in the regulations of the Public Prosecutor’s Office, which requires the intervention of several bodies before the final decision of the Council of Ministers:

  • Proposal by the Minister of the Presidency, Justice and Relations with the Courts.
  • Formulation by the Attorney General of the State.
  • Meeting of the Fiscal Council.
  • Deliberation of the Council of Ministers on August 25, 2026.
  • Signing of the decree by the King on August 26, 2026.

Relevance of the position

The leadership of the Provincial Prosecutor’s Office of Madrid is one of the most coveted and strategic positions within the Public Prosecutor’s Office, given that it concentrates a high number of criminal, economic, and organized crime proceedings. The new chief prosecutor assumes the responsibility of directing the action of the public ministry in the province, with a special impact on matters brought before the Provincial Court of Madrid and the courts of the capital.

With this appointment, the Government renews the leadership of a key prosecutor’s office, at a time when the institution faces organizational challenges and the management of major cases. The publication in the BOE provides full publicity and legal effect to the designation, which becomes effective as of the date of the decree.
