JNE summons Nicolás Barrera Morán as provisional governor of Lima

The Plenary of the National Jury of Elections (JNE) summoned Nicolás Óscar Barrera Morán to provisionally assume the position of governor of the Regional Government of Lima, while the legal situation of the suspended governor Rosa Gloria Vásquez Cuadrado is resolved. The decision is contained in Resolution No. 1755-2026-JNE, published in the official newspaper El Peruano on Thursday, September 3, 2026, within the Legal Norms section.

The measure was adopted after it was proven that the governor falls under the grounds for suspension provided for in numeral 3 of article 31 of Law No. 27867, the Organic Law of Regional Governments (LOGR), which sanctions the existence of a second-instance judicial conviction for an intentional crime with a custodial sentence.

The conviction for intentional embezzlement

Rosa Gloria Vásquez Cuadrado was convicted of a crime against public administration in the form of aggravated intentional embezzlement, provided for in the second paragraph of article 387 of the Penal Code. The sentence, contained in Resolution No. 16 of December 5, 2025, imposed nine (9) years and five (5) months of effective imprisonment, although its execution remained suspended until a final resolution is reached.

The conviction was confirmed by the First Permanent Criminal Appeals Chamber of Ate of the Superior Court of Justice of East Lima, through Resolution No. 6 of May 25, 2026, forwarded to the JNE via Official Letter No. 883-2018-11-JPCOLT-CSJLE/PJ.

The suspension procedure

The Regional Council of Lima declared and formalized the suspension through Regional Council Agreement No. 0149-2026-CR/GRL, dated June 4, 2026, following a process that included the calling of extraordinary sessions and the notification to the governor to present her defense. Since no appeal was filed, the case was elevated to the JNE, which resolved it in the final instance.

In its pronouncement, the Plenary of the JNE ordered:

• To provisionally nullify the credential granted to Rosa Gloria Vásquez Cuadrado as governor of the Regional Government of Lima.
• To summon Nicolás Óscar Barrera Morán, identified with DNI No. 09146477, to provisionally assume the position, granting him the credential accrediting him as such.
• To notify the pronouncement in accordance with the Notification Regulations approved by Resolution No. 0830-2025-JNE.

The summons of the vice-governor

The summons of Barrera Morán, who served as vice-governor, is carried out in accordance with the General Act of Proclamation of Computation Results of the Second Regional Election and Proclamation of elected Governor and Vice-governor for the Regional Government of Lima, dated December 24, 2022, issued by the Special Electoral Jury of Huaura within the framework of the 2022 Regional and Municipal Elections.

The resolution emphasizes that the suspension responds to a cause of an objective nature, verified by a final judicial ruling, and that its purpose is to guarantee the continuity and normal development of the regional management, which could be hindered by the material impossibility of the head of the entity to exercise their functions.

The decision affects the most populous region of the country and leaves a provisional governor in charge of the Regional Government of Lima while the criminal situation of the titular head is ultimately defined, in a case that evidences the impact of corruption convictions on regional governability.
