Ireland Tightens Controlled-Drug Scheduling Under New Misuse of Drugs Rules

The Minister for Health has made two new instruments that amend Ireland’s controlled-drugs regime, published in Iris Oifigiúil (Number 68) on Tuesday, 25 August 2026. The Misuse of Drugs (Amendment) (No. 2) Regulations 2026 (S.I. No. 438 of 2026) and the Misuse of Drugs Act 1977 (Controlled Drugs) (Designation) (Amendment) Order 2026 (S.I. No. 439 of 2026) together adjust the scheduling and designation of controlled substances and the enforcement framework that governs them.

The two instruments sit within the statutory architecture built by the Misuse of Drugs Act 1977 (No. 12 of 1977) and the Misuse of Drugs Act 1984 (No. 18 of 1984). They are the latest in a series of amendments that keep Irish law aligned with evolving international and EU obligations on controlled substances.

Legal basis and scope

The Regulations were made by the Minister for Health in exercise of powers conferred by sections 4, 5 (as amended by section 3 of the Misuse of Drugs (Amendment) Act 2016, No. 9 of 2016), 18 and 38 of the Misuse of Drugs Act 1977 and section 5 of the Misuse of Drugs Act 1984. These provisions cover the classification of controlled drugs, the making of regulations, and related enforcement matters.

The companion Order was made under section 13 of the Misuse of Drugs Act 1977, which governs the designation of controlled drugs. Together the two texts update the list of substances subject to control and the rules applying to their possession, supply and handling.

What the instruments change

• S.I. No. 438 of 2026 amends the Misuse of Drugs Regulations, adjusting the scheduling of controlled substances and the conditions attached to their lawful use.
• S.I. No. 439 of 2026 amends the Controlled Drugs (Designation) Order, updating which substances are designated as controlled drugs under the 1977 Act.
• Both instruments were made by the Minister for Health and take effect through the existing 1977 and 1984 statutory framework.
