Por FactBox Admin

The Anti-Corruption and Good Governance Secretariat has disqualified the company Briteg Instrumentos Científicos, S.A. de C.V. and its former representative, Teresa García Gómez, for one year and imposed a joint fine of 598,220.70 pesos. The measure was communicated through Circular No. AR07-14/2026, published in the Official Gazette of the Federation on October 29, 2026, and takes effect the day following its publication. Consequently, no agency or entity of the public sector may accept proposals or enter into contracts with the company or the sanctioned individual.
The circular was issued by the Responsibilities Area of the Internal Control Body of the Secretariat of National Defense, in compliance with the Third and Fourth resolutions of the Resolution of October 13, 2026, issued in the Administrative Sanction Procedure for Natural and Legal Persons number 002/PAS/2026. The procedure concluded with sanctions for the company and the individual who represented it, derived from non-compliance with the Law on Acquisitions, Leases and Services of the Public Sector and its Regulations.
The invoked legal framework includes articles 109, fraction IV, 113, and 134 of the Political Constitution of the United Mexican States, as well as the Federal Law of Administrative Procedure and the Internal Regulations of the Anti-Corruption and Good Governance Secretariat. The resolution is based on the acquisitions law issued on April 16, 2025, and the Regulations published on December 18, 2025, both in the Official Gazette of the Federation.
The imposed sanctions
The Resolution of October 13, 2026, determined two sanctions applicable to both the company and its representative:
- A fine of 598,220.70 pesos (five hundred ninety-eight thousand two hundred twenty pesos 70/100 M.N.).
- Disqualification for a term of one year from participating directly in procurement procedures or entering into contracts regulated by the Law on Acquisitions, Leases and Services of the Public Sector and its Regulations.
In the case of Teresa García Gómez, the disqualification extends even to the representation of companies other than the sanctioned one, meaning she cannot act as an attorney-in-fact or representative of other legal entities during the term of the sanction.
Scope of the prohibition
The circular is addressed to the agencies and entities of the Federal Public Administration, the Attorney General’s Office of the Republic, the federative entities, the municipalities, and the territorial demarcations of Mexico City. All of them must refrain from accepting proposals or entering into any contract with the sanctioned company, whether directly or through an intermediary.
The prohibition also extends to cases in which Teresa García Gómez intends to represent companies other than the sanctioned one. Federal entities, municipalities, and territorial demarcations are obliged to comply with the circular when acquisitions, leases, and services are contracted using total or partial federal funds, in accordance with the agreements entered into with the Federal Executive.
Current contracts and payment of the fine
Contracts already awarded and those currently formalized with Briteg Instrumentos Científicos, S.A. de C.V. and its representative are not included in the application of the circular, under the terms of Article 112 of the Regulations of the relevant law.
The disqualification has an additional condition: if, upon the expiration of the one-year term, the sanctioned parties have not paid the fine, the measure shall remain in effect until payment is made. To this end, they must present the corresponding supporting document to the Secretaría Anticorrupción y Buen Gobierno (Secretariat of Anti-Corruption and Good Governance), whereby the record of the sanctioned party in the Compras MX portal, formerly CompraNET, will be removed without the need to publish another notice.
The document was signed in Mexico City on October 23, 2026, by the head of the Responsibilities Area, Mr. Tomás Espinosa Ferrer.
Impact on the treasury
The publication closes the administrative cycle of a sanction file and turns the resolution into an operational instruction for the entire public apparatus: as of October 30, 2026, any contracting area that receives a proposal from Briteg Instrumentos Científicos, S.A. de C.V. or from Teresa García Gómez must discard it, even if it arrives under the name of another company. The public registry of sanctioned providers in Compras MX serves as the immediate verification mechanism for procurement areas.
