The Department of Sustainable Development of the Regional Government of Castilla-La Mancha has opened for public consultation the compulsory expropriation of the land necessary to execute the improvement project for the Girasol Drinking Water Treatment Plant (ETAP), in the municipality of Illana (Guadalajara). The resolution, signed in Toledo on September 17, 2026, by the general secretary Mª del Carmen Martín Sánchez, is published in the Official Gazette of the Province of Guadalajara No. 184, of September 28, 2026, under file AA GU/CU-26-004. The owners of the affected properties have 15 business days to oppose or rectify the published list of assets.

Who is promoting the expropriation and under what legal protection

The public law entity Infraestructuras del Agua de Castilla-La Mancha is the beneficiary of the expropriation and has urged the Department to initiate the proceedings, in accordance with Article 22.2 of Decree 7/2011, of February 8, which approves its statutes.

Article 30 of Law 2/2022, of February 18, on Waters of the Autonomous Community of Castilla-La Mancha establishes that the approval of the project implies the declaration of public utility and social interest of the works and the need for urgent occupation of the affected assets and rights, for the purposes of compulsory expropriation, temporary occupation, and the imposition of easements.

The procedure complies with Articles 17, 18, and 19 of the Compulsory Expropriation Law, of December 16, 1954, and Articles 17 and 18 of its Regulation, of April 26, 1957.

Fifteen business days to file claims and where to consult the project

The period of 15 business days is counted from the day following the last of the publications provided for in Article 17.2 of the Regulation: the Official Gazette of Castilla-La Mancha, the Official Gazette of the Province, and a provincial newspaper with wider circulation.

Affected parties may rectify possible errors in the published list or oppose, for reasons of substance or form, the need for occupation, indicating, where applicable, the reasons why they consider the occupation of other assets or the acquisition of other rights to be preferable.

The planned works at the water treatment plant

The purpose of the project is to improve and expand the drinking water treatment infrastructures of the ETAP El Girasol, in order to comply with current regulations on the quality of water intended for human consumption, specifically Directive (EU) 2020/2184 and Royal Decree 3/2023, of January 10. The main actions are:

Replacement of the raw water flow meter and the inlet regulation flow meter, with new instrumentation for the physico-chemical treatment.
Renewal of the floating cover of the raw water tank and the primary settling equipment.
Renewal of the filtration and microfiltration phases, with the replacement of filter material and cartridges.
Construction of a new ultrafiltration treatment phase using membranes, with two parallel lines, in a new process building.
Renewal and improvement of the nanofiltration phase for sulfate reduction.
Actions on the treated water tank, improvement of the main pumping system, and adaptation of the electrical connection, with a new sectioning center, overhead power line, and a supporting photovoltaic park.
Complementary urbanization works, internal roads, purification, and rainwater treatment.

The final objective is to increase treatment capacity, improve the quality of the supplied water, and ensure the sustainability of the system managed by the Mancomunidad de Aguas El Girasol.

Affected owners and plots

The general list of affected parties includes 33 private plots in the municipalities of Illana (Guadalajara) and Leganiel (Cuenca), in addition to public domain assets. Among the holders are:

The holders of public domain assets include the Illana City Council (P1917900A), the Leganiel City Council (P1612500G), the Regional Government of Castilla-La Mancha (S1911001D), and the Tagus Hydrographic Confederation (Q2817005H), whose assets are published for purely informative purposes.

Impact for those affected

The publication opens the decisive procedure for the owners in Illana and Leganiel: anyone who does not file objections within fifteen business days will see the list of assets and rights supporting the urgent occupation of their properties consolidated. The improvement of the Girasol DWTP affects the drinking water supply of the region, therefore the file combines the public interest of the supply with the defense of the property rights of the expropriated holders.
