Public information for the public utility of the Henar III wind farm

The Official Gazette of Aragon publishes this Wednesday, September 30, 2026, in issue number 190, the announcement by which the Provincial Service of Zaragoza submits for public information the request for the declaration of public utility of the PE Henar III wind farm, promoted by Energía Inagotable del Proyecto Henar III, SL in the municipal districts of Cariñena and Tosos. The resolution corresponds to the Minister of Economy, Competitiveness and Employment, while the processing depends on the Provincial Service of Zaragoza. The file is identified with the reference G-EO Z-313-2020 // DUP-Z-2021-0044.

Legal framework and expropriation consequences

The procedure is based on Law 24/2013, of December 28, on the Electricity Sector, and on article 144 of Royal Decree 1955/2000, of December 1, which regulates the activities of transport, distribution, marketing, supply, and the authorization procedures for electrical installations.

The declaration of public utility, in accordance with article 56 of Law 24/2013 and article 149 of Royal Decree 1955/2000, will implicitly entail the need for the occupation of assets or the acquisition of rights reflected in the annex of the announcement. Furthermore, it will imply urgent occupation for the purposes of article 52 of the Law on Compulsory Expropriation, which accelerates the availability of the land for the promoter.

The announcement is specifically addressed to the owners and holders affected by the installation, as well as those who, being holders of real rights or economic interests over the assets, may have been omitted from the published list.

Allegations and consultation of the file

Interested parties have a period of thirty days starting from the day following the publication of the announcement to submit allegations, in accordance with article 16.4 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

• Allegations must be addressed to the Provincial Service of Zaragoza, with the reference “Allegations regarding the declaration of public utility. File: G-EO Z-313-2020 // DUP-Z-2021-0044”.
• The technical documentation regarding the affected areas is available on the Government of Aragon website, under the link for projects in public information.
• It may also be consulted at the offices of the Provincial Service of Zaragoza, at María Agustín promenade, number 36, Pignatelli building, in the Administrative Information and Documentation Service of the same building, and at the affected town hall, during business days and hours.

The publication is carried out for the purposes of notification provided for in Article 45 of Law 39/2015. The announcement appears signed in Zaragoza on July 13, 2026, by the director of the Provincial Service of Zaragoza, Ana Elena Romero Aznar.

Affected assets and rights

The annex incorporates the individualized list of assets and rights affected by the Henar 3 Wind Farm, with estates located in Tosos and Cariñena and cadastral references for polygons 00011, 00013, 00018, 00019, 00021, and 00052.

• Identified wind turbines: HE3-01, HE3-02, HE3-07, and HE3-08.
• Affected areas: wind turbine platforms, wind turbine flight paths, underground lines (length and surface), roads, right-of-way for surveillance and conservation, access roads, and temporary occupation.
• Affected land uses: rain-fed arable land, rain-fed vineyards, almond trees, pastures, wasteland, and unproductive land.
• Parcels of public domain communication routes and natural hydrography (river, lagoon, or stream) are also listed.

The annex itself specifies that parcels belonging to official bodies or dependent companies are included for informational purposes and for the effects of points 2 and 3 of Article 149 of Royal Decree 1955/2000.

Impact for those affected

The opening of the public information period initiates the final relevant step before the Minister of Economy, Competitiveness, and Employment rules on the public utility of the wind farm. For the owners of the estates included in the annex, the thirty-day period is the only window to file allegations before an eventual declaration enables the urgent occupation of their land and, where applicable, compulsory expropriation.
