Industria convoca actas previas de expropiación en Escalante por Alvareo 1

The General Directorate of Industry, Energy and Mines of the Government of Cantabria has called for the drawing up of records prior to the occupation of the estates affected by the modification of the relocation project for transformation center 11226 Alvareo 1, in the municipality of Escalante. The appearance will take place on November 26, 2026, at 11:00 AM, at the Escalante Town Hall, according to the resolution published in the Official Gazette of Cantabria no. 210, of November 2, 2026 (reference CVE-2026-8493).

From the February authorization to urgent occupation

The call stems from the Resolution of the General Directorate of Industry, Energy and Mines of February 3, 2026, published in the Official Gazette of Cantabria no. 30, of February 13, 2026, and in the Official State Gazette no. 39 of the same date, which granted the prior administrative and construction authorization and declared the public utility of the facilities of the transformation center relocation project. The case file is AT-129-2023.

The declaration of public utility implies the need for the occupation of the affected assets and rights and further implies urgent occupation for the purposes of Article 52 of the Law of December 26, 1954, on Compulsory Expropriation. The procedure is processed in accordance with Articles 54, 55, and 56 of Law 24/2013, of December 26, on the Electricity Sector, and Chapter V of Title VII of Royal Decree 1955/2000, of December 1, and its implementing Regulation, approved by Decree of April 26, 1957.

The resolution is dated in Santander on October 26, 2026, and signed by the Director General of Industry, Energy and Mines, José Luis Ceballos Pereda. In the expropriation file, Viesgo Distribución Eléctrica, S. L. assumes the status of beneficiary.

A single appointment and mandatory documentation

The drawing up of records will be held on a single day at the headquarters of the Escalante Town Hall, where the estates are located, and will be communicated to each interested party via the appropriate summons notice. Those summoned must attend with:

  • Document proving ownership: property deed or updated registry note (nota simple).
  • Latest receipt of the Real Estate Tax (IBI).
  • Personal appearance or via a duly authorized representative.

Interested parties may be accompanied, at their own expense, by an expert and a notary if they deem it appropriate. The resolution is also published through the channels of Article 44 of Law 39/2015, of October 1, for cases of unknown ownership or unknown address.

Two plots of polygon 4 and eleven affected owners

The list of owners, assets, and rights attached to the resolution affects two rural estates in polygon 4 of Escalante, both used for pasture cultivation:

  • Plot 1, cadastral reference 39029A004000010000UM: 24 square meters affected by piping, with one manhole and 7.47 meters of access.
  • Plot 2, cadastral reference 39029A004000020000UO: 406.72 square meters of affected surface, with a support of 1.21 square meters, six manholes and 129.83 linear meters of access.

The owners cited for the first property are Damián Cubillas Pérez, José María Cubillas Pérez, Evaristo Cubillas Pérez, Tomás Cubillas Pérez, the heirs of Liborio, Teresa García Lavín, Jesús Cubillas García and Alejandro Cubillas García. For the second, Juan Carlos Mazón Nieto, Juan José Mazón Nieto de Cossío, María Teresa Mazón Nieto de Cossío (heirs of) and Jesús Mazón Nieto are listed.

The calendar that opens the way to occupation

With the prior act, the surface actually occupied is fixed and the negotiation of the fair price begins; if no agreement is reached, the file is referred to the Provincial Jury of Compulsory Expropriation. Since it is an urgent occupation, the Administration may take possession of the land before the economic valuation is closed, so that the owners collect the prior deposit and, subsequently, the determined difference.

For those affected, the procedure on November 26 is the first formal occasion to prove ownership, review the surface attributed to them, and appoint their own expert. The appointment comes nine and a half months after the February authorization and affects a total of eleven owners in two pasture cultivation plots, in a procedure that does not allow for suspension via ordinary administrative channels.
