INDER opens ten-day opposition period to regularize lands in settlements

The Rural Development Institute (INDER) is processing a land regularization request for settlements in the Huetar Caribe Region and in Sixaola, based on Article 85, subsection c) of Law 9036. The publication appears in La Gaceta No. 175 on Thursday, September 17, 2026, under official reference IN202601117910, and opens a ten-day period for interested parties to come forward. The notice is signed by Manuel Rojas Sanabria, Regional Legal Advisor of the Huetar Caribe Regional Directorate (DRHC).

The process is based on Article 146 of the Executive Regulations of Law 9036, published in Supplement 165 of La Gaceta No. 163 on August 25, 2021, a provision that mandates the publicity of regularization processes so that any interested person may object. Law 9036 is the transformation statute for INDER, the institution that administers the Land Fund and the settlements of the Huetar Caribe Region.

The notice is published for the first time and orders the notification of three edicts in the Official Gazette. The involved properties are located in Settlement País 8C, Settlement País 6C, and the Sixaola Settlement, in the province of Limón.

Eleven people and nine cadastral plans

The request involves eleven people and nine cadastral plans:

Ten-day period and means of opposition

Interested parties must express themselves before the corresponding Territorial Office or before the Huetar Caribe Development Region, headquartered in Talamanca, province of Limón. The period is ten days starting from the day following the notification made through this medium.

The resolution is notified via three edicts in the Official Gazette, a mechanism provided for cases where personal notification is not possible. The notice is identified as a first-time publication.

Regulatory Basis and Scope of the Procedure

Article 85, subsection c) of Law 9036 is the mechanism invoked by INDER to regularize the tenure of these properties, while Article 146 of the Executive Regulation of said law establishes the obligation to publish the process. The management is handled by the Huetar Caribe Development Region and Land Fund, with the support of the regional legal advisory.

The procedure covers parcels ranging from 171.25 m² to properties of more than 16,000 m², with cadastral plans issued between 2024 and 2026, as well as carry-over plans from previous years.

The regularization of land in settlements defines the legal certainty of the families who occupy and exploit these properties in the Huetar Caribe Region. The ten-day period is the only opportunity provided in the edict for third parties with conflicting rights to present their opposition before the competent authority.
