Hoyos: the mayor delegates her functions due to medical leave

The Mayor of Hoyos, Mónica Moralejo Rodríguez, has delegated all mayoral functions to the second deputy mayor, Raquel Gordo Sandín, during her period of absence due to medical leave. The decision was adopted by Mayoral Resolution No. 2026-0370, signed in Hoyos on August 24, 2026, and published in the Official Gazette of the Province of Cáceres (BOP) on Thursday, August 27, 2026, in Section I of Local Administration.

The delegation occurs after the first deputy mayor, Gonzalo Pérez Zanca, submitted his express resignation via general application with registration number 2026-E-RE-220 on August 24, 2026. The mayor has been on medical leave effective from August 19, 2026, a circumstance that had already been published in the BOP on July 21, 2026.

Legal Framework of the Substitution

The measure is supported by Article 23.3 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, as well as Articles 44 and 47 of the Regulations on the Organization, Operation, and Legal Regime of Local Entities, approved by Royal Decree 2568/1986, of November 28. These regulations provide that deputy mayors shall substitute for the mayor, in order of their appointment, in cases of absence, illness, or impediment.

Scope of the Delegation

The delegation conferred upon Raquel Gordo Sandín includes the powers of direction and management, as well as the power to resolve administrative procedures through the adoption of administrative acts affecting third parties. The delegated body must:

• Inform the Mayor’s Office, a posteriori and when requested, of the management carried out and the provisions issued.
• Communicate decisions of significance in advance, in accordance with Article 115 of the Regulations on the Organization, Operation, and Legal Regime of Local Entities.
• Accept the delegation, which shall be understood as tacitly granted if no express statement of non-acceptance is made within three business days from notification.

Publication and Appeals

The resolution will be published in the BOP, and its content will be reported to the Plenary of the Corporation at the first session it holds. Against the decree, which exhausts administrative remedies, an appeal for reversal may be filed with the Mayor’s Office within one month, or a contentious-administrative appeal may be filed before the Contentious-Administrative Section of the Court of First Instance of Cáceres within two months.

The delegation ensures the continuity of the municipal management of Hoyos during the mayor’s absence, a relevant change in the leadership of the City Council that now falls to the second deputy mayor following the resignation of the first deputy.
