Horsens court set to confirm 52.94 percent dividend in TRIAX estate

Retten i Horsens will hold the final creditors’ meeting (afsluttende skiftesamling) in the bankruptcy estate of TRIAX A/S on Tuesday 17 November 2026 at 09:00 to consider and, if nothing prevents it, confirm draft accounts and a distribution paying a dividend of 52.94 per cent to claims registered under section 95 of the Danish Bankruptcy Act. The notice was published in Statstidende on 29 October 2026 under reference S27102026-106 and signed by the court on 27 October 2026. Should the accounts be confirmed, the estate will pay out four weeks later.

The estate is handled under case number SKS 41-264/2023 at Retten i Horsens, and the company is registered with CVR-nr. 29119511 at Bjørnkærvej 3, 8783 Hornsyld. The announcement appears in the gazette’s bankruptcy section under the heading “Regnskab og boafslutning” — accounts and closing of the estate — which is where courts publish the last procedural step in an insolvency before it is wound up.

The final skiftesamling is the point at which the estate’s administration is presented to the creditors and the court for approval. The draft accounts and distribution schedule (“udkast til regnskab og udlodning”) have been laid out for inspection at the skifteret, and the notice states that claims and other demands first registered after the accounts are confirmed will not be taken into consideration.

What the 52.94 per cent figure means

A dividend of 52.94 per cent to section 95 claims means that more than half of the value of each admitted claim in that class is repaid. The percentage is the rate fixed in the draft distribution and applies to the claims admitted in the estate; the notice published on 29 October sets out the rate and the timetable but does not state the total amount of admitted claims or the size of the estate’s assets.

The notice also does not mention any dividend to section 97 claims, the class that ranks behind the section 95 claims in a bankruptcy distribution. For the creditors covered by the 52.94 per cent rate, the figure is the decisive information in the announcement, since it determines how much of their claim the estate will actually pay.

Time, place and procedural deadlines

The announcement sets out the practical terms of the hearing and the subsequent payout:

  • Hearing: Retten i Horsens, Mødelokale 2 on the first floor, Godsbanegade 2, 8700 Horsens.
  • Date and time: Tuesday 17 November 2026 at 09:00.
  • Estate: TRIAX A/S, CVR-nr. 29119511, Bjørnkærvej 3, 8783 Hornsyld.
  • Case number: SKS 41-264/2023.
  • Inspection: the draft accounts and distribution schedule are available for review at the skifteret.
  • Late claims: claims first registered after the accounts are confirmed are disregarded.
  • Payment: made four weeks after confirmation, unless an appeal has been lodged before then.

Other estates on the same court list

The sitting in Mødelokale 2 is not devoted to a single estate. At the same time on 17 November, Retten i Horsens also lists the final skiftesamling in the estate of NEERGAARD STALDDESIGN A/S, CVR-nr. 25973690, Hornsyld-address Christiansmindevej 26 in Skanderborg, case SKS 41-202/2025, with a proposed dividend of 23.169292 per cent to section 95 claims. Both announcements were signed by the court on 27 October 2026 and carry the same inspection, late-claim and payment conditions.

For creditors in the TRIAX A/S estate, 17 November 2026 is the operative date: once the accounts are confirmed the administration is final and claims that have not been registered by then fall outside the distribution. The 52.94 per cent rate means that creditors in the section 95 class recover more than half of their admitted claims, and that payment is expected in mid-December 2026 if no appeal is filed.
