Horche delegates the Mayor's Office to Virginia Manzano during the councilman's vacation

The Horche City Council has delegated all mayoral functions to the second deputy mayor, Virginia Manzano Nuevo, for the period between September 28 and October 2, 2026, both inclusive. The measure is in response to the absence of the municipality’s mayor due to vacation and is formalized in Mayoral Resolution No. 2026-0757, dated September 22, 2026, published in the Official Gazette of the Province of Guadalajara No. 183, dated Friday, September 25, 2026.

A substitution supported by local regulations

The resolution is based on the premise that it is the responsibility of the deputy mayors, in their capacity as such, to substitute for the mayor in all their functions, in order of their appointment, in cases of absence, illness, or impediment that makes the exercise of their powers impossible. The text also recalls that this substitution applies equally in cases of vacancy in the Mayor’s office until the new mayor takes office.

The agreement is adopted by virtue of Article 23.3 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and in accordance with Articles 44 and 47 of the Regulations on the Organization, Operation, and Legal Regime of Local Entities, approved by Royal Decree 2568/1986, of November 28. The document was signed in Horche on September 22, 2026, by the mayor-president, Manuel Salvador Ruiz.

Scope of the delegated powers

The second section of the resolution specifies the content of the delegation, which includes:

• The direction and management powers inherent to the Mayor’s office.
• The resolution of appropriate administrative procedures through the adoption of administrative acts affecting third parties.

The delegated body must inform the Mayor’s office, a posteriori and whenever requested, of the management carried out and the provisions issued during the reference period. Prior communication must be given regarding decisions of significance, as provided for in Article 115 of the aforementioned state regulation.

Acceptance, publication, and means of appeal

For the delegation to be effective, it requires the acceptance of the delegated body, which will be understood as tacitly granted if no express manifestation of non-acceptance is filed with the Mayor’s office within three business days starting from the day following the notification of the resolution. The regulation is published in the Official Gazette of the Province, and its content will be reported to the Plenary of the Corporation at its first session.

Against the decree, which concludes the administrative route in accordance with Article 52 of Law 7/1985, an optional appeal for reversal may be filed prior to any other action before the Mayor’s Office within one month from the day following notification, or alternatively, a contentious-administrative appeal may be filed directly before the Contentious-Administrative Court of Guadalajara within two months.

Coincidence with another delegation in the same bulletin

The same issue of the provincial bulletin includes a delegation of similar characteristics in the City Council of Tendilla. A mayoral decree dated September 23, 2026, delegates all functions of the Mayor’s Office to the first deputy mayor, Israel Pérez Ortega, also between September 28 and October 2, 2026, due to the councilor’s absence for vacation, with identical regulatory backing and an analogous regime of acceptance, information, and appeals.

The publication of both resolutions confirms that the coincidence of dates corresponds to the vacation period of municipal staff and not to an extraordinary situation in either of the two town halls.

Impact for residents

During the five specified days, administrative decisions, the direction of municipal services, and the resolution of files affecting third parties in Horche will correspond to Virginia Manzano Nuevo, without this altering the ownership of the Mayor’s Office or requiring a plenary session call. Residents with pending matters therefore maintain an identified and officially published competent body to submit documents and receive resolutions.
