Horcajo de los Montes regula la tenencia de animales potencialmente peligrosos

The Plenary of the City Council of Horcajo de los Montes initially approved, in an ordinary session held on November 4, 2026, the Ordinance regulating the protection and ownership of potentially dangerous animals. The agreement is published by edict in the Official Gazette of the Province of Ciudad Real number 215, dated Friday, November 6, 2026, under announcement number 3594, and opens a public information period of 30 business days.

The regulation is not yet in force: this is an initial approval that must pass the public exhibition before being finalized. The edict expressly invokes articles 49 and 70.2 of Law 7/1985, of April 2, regulating the Bases of Local Regime, and article 56 of Royal Legislative Decree 781/1986, of April 18, which approves the Revised Text of the legal provisions in force regarding Local Regime, which require that agreements for the approval of ordinances be submitted to the public information process.

The announcement was signed in Horcajo de los Montes on November 5, 2026, by the mayor, Julián Fernández Abellán, and does not reproduce the articles of the ordinance. The full content of the file, therefore, can only be examined at the municipal headquarters during the enabled period.

Thirty business days to file objections

The calculation of the period begins the day following the insertion of the announcement in the BOP, that is, November 7, 2026, and extends for 30 business days. During this interval, any interested party may examine the file and present any claims they deem appropriate.

The terms of the process are as follows:

  • Deadline: 30 business days from the day following the publication of the announcement in the Official Gazette of the Province.
  • Place of consultation: offices of the Municipal Secretariat, located at Plaza de España, S/N, Horcajo de los Montes.
  • Purpose of the process: examination of the file and submission of claims.
  • Effect if there are no objections: the agreement will be considered definitively approved.

Automatic definitive approval if there are no objections

The edict establishes that, once the period has elapsed without any objections having been presented, the initial approval agreement will be elevated to definitive without the need for a new pronouncement by the Plenary. This is the usual mechanism in the processing of local ordinances and regulations, which avoids a second vote when the text has received no objections during the public exhibition.

The full file is published on the corporation’s electronic headquarters, as stated in the signature footer of the document, where authenticity can be verified using the secure verification code zQ3+6L/M9Lwe4X0704/t.

Other municipalities in the province have already regulated the matter

Municipal regulation of potentially dangerous animals has recent precedents in the province. The Los Pozuelos de Calatrava City Council definitively approved its Regulatory Ordinance for the Registry of Potentially Dangerous Animals by Plenary agreement on July 13, 2026, published in BOP number 169, of September 3, 2026, following a 30-day public information process announced in BOP number 113, of June 17, 2026, and without any claims being filed.

In that case, the regulation was limited to the municipal registry of this type of animal, whereas the text currently being processed by Horcajo de los Montes expands its scope to protection and ownership, according to the title stated in the edict. The specific scope of the new obligations for owners must be verified in the articles of the file, which the announcement does not detail.

The relevance of the measure is practical for the residents of the municipality: the future ordinance will establish the conditions for keeping these animals and the obligations of their owners, and the period open until the beginning of next December is the only opportunity to influence the text before it is definitively approved.
