Home Affairs revokes security regulated status of Ngujima-Yin offshore facility

The Department of Home Affairs has revoked the declaration that made Ngujima-Yin a security regulated offshore facility, ending the maritime security obligations attached to that status. The revocation was made under subsection 17B(1) of the Maritime Transport and Offshore Facilities Security Act 2003 by a delegate of the Secretary of the department and commenced upon publication in the Gazette. It appears as notice NTC-31575 in the Commonwealth of Australia Gazette of 3 November 2026, registered under reference C2026G00715.

The instrument is a single-operative revocation with immediate effect: because the notice commences on publication, there is no transition or wind-down period for the vessel’s regulated status. The delegate signed it on 29 October 2026, and it was registered in the Government Notices Gazette of 3 November 2026. The declaration it removes had been in place since January 2015.

What the notice does

Notice NTC-31575, headed “Declaration of Security Regulated Offshore Facility – Ngujima-Yin”, contains one operative instruction and a commencement provision:

  • It revokes Notice NTC-5151, which had declared Ngujima-Yin a security regulated offshore facility.
  • It is made under subsection 17B(1) of the Maritime Transport and Offshore Facilities Security Act 2003.
  • It commences upon publication in the Gazette.
  • It remains in force until otherwise revoked in writing and upon subsequent publication in the Gazette.

The notice carries no conditions, savings or transitional arrangements, and no replacement declaration for the vessel is included in the instrument.

The 2015 declaration being undone

The declaration revoked by the new notice was published as NTC-5151 in the Gazette of 9 January 2015, under reference C2015G00052. That 2015 instrument is the sole declaration cited in the revocation, so the effect of NTC-31575 is that Ngujima-Yin ceases to hold the security regulated offshore facility status conferred on it eleven years ago.

Signatory and registration

The notice was signed by Michaela Featherstone (Position No: 48000469), a delegate of the Secretary of the Department of Home Affairs, on 29 October 2026, five days before registration.

  • Issuing body: Department of Home Affairs.
  • Legal basis: subsection 17B(1), Maritime Transport and Offshore Facilities Security Act 2003.
  • Notice number: NTC-31575.
  • Gazette reference: C2026G00715, registered 3 November 2026.
  • Commencement: on publication in the Gazette.

The same Gazette edition carried a parallel Home Affairs instrument, C2026G00714 (NTC-31568), signed the same day by delegate Gerome Balangue, which revoked and re-declared Mackay Airport as a security controlled airport and re-established its airside area under the Aviation Transport Security Act 2004.

Relevance

The notice formally removes Ngujima-Yin from the offshore facility security regime administered by Home Affairs, so obligations flowing from that designation no longer apply from the date of publication. Operators, contractors and maritime security providers dealing with the vessel should treat the 2015 declaration as spent and rely on the Gazette text of NTC-31575 as the operative record.
