Hjørring court declares Future Care Caspersvej bankrupt at authority's request
Por FactBox Admin

Retten i Hjørring declared Future Care Caspersvej ApS bankrupt by decree of 28 October 2026, placing the company under bankruptcy proceedings in case SKS SKIF-350/2026. The ruling came at the request of Erhvervsstyrelsen (the Danish Business Authority), which had sought compulsory dissolution on 26 August 2026 under case SK-827/2026-HJO. The decree was published in Statstidende on 30 October 2026, in the bankruptcy section, as announcement S28102026-93.
The announcement identifies the debtor by its CVR number, 44369907, and its registered address at Åhavevej 20, 9300 Sæby. The company is described in the decree as being “under tvangsopløsning” — the compulsory-dissolution track opened at the authority’s request — before the court converted the matter into a full bankruptcy. Statstidende is Denmark’s official gazette for legal announcements, issued by Civilstyrelsen under Justitsministeriet, and a bankruptcy decree is the formal instrument by which a skifteret opens an estate and appoints the officer who will administer it.
Trustee appointed in Copenhagen
The estate is to be administered by a single trustee, advokat Cathrine Ohff Wollenberg Zittan, whose address is given in the decree as Kalvebod Brygge 32, 1560 København V. The announcement gives no statement of the company’s line of business; it confines itself to the identity of the debtor, the case numbers and the procedural instructions that follow automatically from the court’s ruling. The same decree lists Retten i Hjørring as the probate court handling the estate, and it is dated at Hjørring on 28 October 2026.
Four weeks to file claims
Two deadlines follow from the publication, both counted from the date the announcement appears:
- Claims: anyone holding a claim or other right against the debtor is called on to notify the estate’s trustee within four weeks of the announcement, with the claim stated as at 28 October 2026. The decree advises that the notification be accompanied by documentation of the claim.
- Election of trustee and creditors’ committee: any request for an election of trustee or of a creditors’ committee must be submitted in writing to the skifteret no later than three weeks after the announcement.
- Probate court: Retten i Hjørring, which issued the decree on 28 October 2026.
Because both periods run from publication rather than from the court’s own date, the four-week window for creditors in practice extends into late November 2026.
A second company under the same name
The bankruptcy is not the only Statstidende announcement concerning the Future Care name to come out of Retten i Hjørring in recent weeks. An announcement dated 2 October 2026 records that a co-trustee, advokat Cathrine Ohff Wollenberg Zittan, was appointed in the estate of Future Care Flauenskjold ApS, CVR number 42877964, registered at Ålborgvej 584, 9330 Dronninglund, in case SKS SKIF-238/2026. That announcement describes an appointment of a medkurator within an existing estate and states no connection between the two companies beyond the shared name and the same court district; nothing in the 30 October decree links the two cases procedurally.
What the ruling changes for those involved
For anyone dealing with Future Care Caspersvej ApS, the decree fixes the cut-off point for the estate: claims are to be calculated as at 28 October 2026, which means interest and other accruals stop being counted from that date for the purposes of the filing. Creditors who miss the four-week deadline risk having their claims excluded from the ordinary review, and the three-week window is the only point at which the choice of trustee can be contested before the probate court. Until the trustee has completed the estate’s administration, the company’s affairs are conducted through the estate rather than by the company’s own management.
