Higuera la Real opens the application period to choose a substitute Justice of the Peace

The Higuera la Real City Council has opened the application period for the election by the Corporation’s Plenary of the position of Substitute Justice of the Peace for the municipality. The call, signed by the Mayor-President Juan Ramón Luna Carretero, is published in the Official Gazette of the Province of Badajoz, number 159, dated August 20, 2026, under announcement 3313/2026.

Interested parties will have thirty calendar days, counting from the day following the publication of the edict, to submit their written application at the general registry of the City Council.

Legal Framework of the Call

The call is processed in compliance with the provisions of Articles 101 and 102 of Organic Law 6/1985, of July 1, of the Judiciary, which regulate the filling of the positions of titular and substitute Justice of the Peace. The election corresponds to the Plenary of the municipal Corporation, which will designate the person who will hold this position of relevance for the administration of local justice.

Required Documentation

Those wishing to apply for the position must accompany their application with the following documentation:

• Copy of the ID (DNI).
• Criminal record certificate.
• Responsible declaration stating that they are not subject to any cause of incompatibility or incapacity.
• Responsible declaration regarding their current profession.
• Medical certificate stating that they do not suffer from any physical or psychological illness or defect that prevents the performance of the duties of the position.

Exemption for Practicing Judges

In the event that the interested person currently holds the position of titular or substitute Justice of the Peace, and in accordance with Article 28.2 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, it will not be necessary to present the criminal record certificate, the medical certificate, nor the responsible declaration of not being subject to any cause of incompatibility.

The figure of the Justice of the Peace is essential for the administration of justice in municipalities without a court of first instance, as they assume functions of conciliation and the knowledge of minor matters. Filling the substitute position guarantees the continuity of the judicial service in Higuera la Real in the event of absences or vacancies of the titular judge; therefore, this call constitutes a key step in ensuring the correct functioning of local justice.
