The Government has corrected typographical errors in the job positions for special education needs support staff

The Governing Council of the Basque Government approved Decree 147/2026 on September 15, and it was published in issue number 189 of the Official Gazette of the Basque Country on October 2, 2026, with official reference 2026/4083. This decree corrects typographical errors in Decree 46/2026, specifically three gaps detected—in the seventh amendment—in the list of non-teaching labor positions to support students with special educational needs. The correction was made upon the proposal of the Department of Education and does not change the content of the list, only the incorrect numbering of the allocations.

What is being corrected

The text of the regulation specifies three typographical errors, all regarding the numbering of the position allocations. Decree 46/2026 is dated March 24, 2026, and was published in issue number 65 of the Official Gazette of the Basque Country on April 9, 2026. The basis for the correction is Article 18.2.c) of Decree 217/2008: errors and omissions detected in the text sent for publication, which cannot be clearly inferred from the context and could truly change the content or meaning, shall be corrected by a provision of the same level.

Physiotherapist positions: 36 and 38 swapped

The correction affects two physiotherapist positions, both numbered 3473 and attached to a Berritzegune in the Delegation of Álava. In this case, the allocation numbers were swapped:

• In the position with code G03, where it said 36, it should say 38; qualification code 252552, HLEA language requirement, preceptivity date September 1, 2022, complement 807, and 50% dedication.
• In the position with code G06, where it said 38, it should say 36; the remaining characteristics are the same: qualification code 252552, HLEA, September 1, 2022, complement 807, and 50% dedication.

Specialist position: from 238 to 604

The third correction corresponds to position number 3470, known as an educational support specialist, and involves a change in the language profile. It stated that the allocation was 238, and it should be 604. The remaining data for the position are as follows:

• Qualification codes 422400 and 422200, HLEA language requirement, preceptivity date September 1, 2025, complement 807, and 100% dedication.
• The destination is Berritzegune A01, and the notes state that the position is filled by personnel with HLEA.

Entry into force and appeals

The decree shall enter into force the day following its publication, that is, October 3, 2026. As it exhausts the administrative route, interested parties have two options:

• A voluntary appeal before the Governing Council, within a period of one month starting from the day after its publication.
• A contentious-administrative appeal before the contentious-administrative chamber of the High Court of Justice of the Basque Autonomous Community, within a period of two months starting from the day after its publication.

The decree was signed in Vitoria-Gasteiz on September 15, 2026. The signatories are President Imanol Pradales Gil and Minister of Education María Begoña Pedrosa Lobato.

Impact

This correction does not create any new positions nor remove any; it only adjusts the numbering of the endowments to ensure the practical application of the list is correct. However, it is important for the affected collective: it specifies the number and distribution of non-teaching labor positions that assist students with special educational needs, and an incorrect numbering could cause inconsistencies in staff management and the provision of positions.
