Haro delegates drinking water contracts to its Governing Board
Por FactBox Admin

The Haro City Council has delegated to the Local Government Board the authority to approve the file, open the award procedure, and approve the expenditure for contracts regarding drinking water supply, network repair, and meter replacement. The agreement of the Plenary, adopted unanimously in the session of October 29, 2026, is published in the Official Gazette of La Rioja no. 213, of November 4, 2026, with reference BOR-A-20261104-III–4142.
A unanimous agreement of the Plenary
The municipal Plenary held a session on October 29, 2026, and approved the delegation by unanimity of those present, following the report of the Municipal Information Commission on Works, Urban Planning, and Housing, dated the same day. The administrative file is numbered 202611020125354, and the agreement is disseminated in section III of the gazette, dedicated to other provisions and acts, under ordinal III.4142 on page 18766.
The legal authorization of the measure is based on two regulations:
- Article 22.4 of Law 7/1985, of April 2, regulating the Bases of Local Regime, which allows for the delegation of Plenary matters to the Mayor’s Office and the Local Government Board.
- Article 51.3 of Royal Decree 2568/1986, of November 28, which approves the Regulation of Organization, Operation, and Legal Regime of Local Entities, which requires the scope of delegated matters, specific powers, and conditions of exercise to be established.
What is delegated and what the Plenary retains
The delegation covers three acts of contract preparation, across three blocks of services:
- Operation and maintenance of the drinking water supply system.
- Repairs to the water distribution network and municipal sanitation.
- Renewal and replacement of consumption water meters.
The Local Government Board will act as the contracting body and will also assume the resolution of any incidents that arise in the file. In contrast, the agreement expressly excludes two powers: that of carrying out the award and that of resolving the effects and termination of the contract, which remain in the hands of the Plenary.
Publication, effects, and internal control
The agreement orders the publication of the delegation in the Official Gazette of La Rioja, effective from the day following its adoption, and to report what was approved to the Local Government Board in the next session it holds. The document was signed in Haro on November 2, 2026, by the Mayor-President, Guadalupe Fernández Prado, and consists of a single page.
The delegation does not set tender amounts or execution deadlines: it is limited to ordering who processes and authorizes the expenditure on a matter that affects an essential service for all residents of the municipality.
Impact for the residents
Drinking water, sewerage, and meters are daily-use services, meaning that any delay in the processing of their contracts immediately impacts the quality of the service. By concentrating the approval of the file and the expenditure within the Local Government Board, the Haro City Council seeks to streamline procedures that until now required approval by the Plenary, which in any case retains the final decision on to whom the contract is awarded and when it is terminated.
