Por FactBox Admin

The Plenary of the Haro City Council has delegated to the Local Government Board the exercise of competencies for the approval of the file, the opening of the award procedure, and the approval of the expenditure for the expansion work of the existing sports center and the creation of a multipurpose pavilion in El Ferial. The agreement is published in the Official Gazette of La Rioja (BOR) no. 187, of September 29, 2026, section III, page 16434, with official reference BOR-A-20260929-III–3660 and file 202609250124647.
The agreement was adopted in the Plenary session held on March 25, 2026, by majority, upon the proposal of the Municipal Information Commission for Works, Urban Planning, and Housing, whose report is dated March 23, 2026. The published resolution is signed by the Mayor-President, Guadalupe Fernández Prado, dated September 25, 2026.
The legal authorization of the measure is based on Article 22.4 of Law 7/1985, of April 2, Regulating the Bases of Local Regime, and Article 51.3 of Royal Decree 2568/1986, of November 28, which approves the Regulation of Organization, Operation, and Legal Regime of Local Entities.
What is delegated and what the Plenary reserves
The agreement transfers to the Local Government Board the preparatory acts of the contract, which include:
- The approval of the procurement file.
- The opening of the award procedure.
- The approval of the expenditure for the work.
- The resolution of any incidents that arise in the file, acting as the contracting body.
The delegation has express limits: the authority to carry out the award and to resolve matters regarding the effects and termination of the contract are not delegated and remain with the Plenary.
Publication, effects, and control
The agreement orders the publication of the delegation in the Official Gazette of La Rioja, effective from the day following its adoption. Furthermore, the Local Government Board must report on this agreement in the next session it holds, as an internal control mechanism for the exercise of the delegated competence.
The project in El Ferial
The contracted action consists of the expansion of the existing sports center and the creation of a multipurpose pavilion in the area of El Ferial, in Haro. This is a works contract, not a supply or service contract, which places the file within the scope of municipal sports infrastructure procurement.
The Haro City Council already regulates the use of its municipal sports facilities, including the El Mazo Municipal Sports Complex and El Ferial, through the regulation published in the Official Gazette of La Rioja no. 168, of September 2, 2026, which expressly contemplates possible future expansions of the sports spaces.
The file does not include the tender budget or the execution period in the published text, data which must be specified in the specifications when the Local Government Board approves the file and opens the award procedure.
The delegation streamlines the processing of a major project for local sports and opens a relevant opportunity for construction companies interested in contracting with the Haro City Council. By concentrating the preparatory acts in the Local Government Board, the Council reduces administrative deadlines, although it maintains the final decision on the award and the termination of the contract in the Plenary.
