Hacienda abre alegaciones para vender una finca estatal en Alhucemas

The Ministry of Finance has initiated the direct disposal procedure for a property owned by the State Patrimony located at Alhucemas Street S/N in Melilla. The agreement, adopted by the Delegation of Economy and Finance of Melilla on September 28, 2026, is published in the Official Gazette of the Autonomous City of Melilla number 6419, dated October 2, 2026, with the reference BOME-A-2026-1113. The resolution opens a period of ten business days for any party interested in the procedure to submit the allegations and documents they deem appropriate.

The operation is supported by Article 137.4.i) of Law 33/2003, of November 3, on the Patrimony of Public Administrations (LPAP), which enables the direct sale of patrimonial real estate in certain cases, without the need to resort to a public auction. The asset belongs to the General State Administration and its management corresponds to the State Patrimony Section of the Delegation of Economy and Finance of Melilla, a body dependent on the Ministry of Finance.

The announcement is published for general knowledge and affects an urban land property in a consolidated area of the city; therefore, the call for allegations is of interest to both potential buyers and holders of rights or interests in the property.

Property Data

The announcement identifies the patrimonial asset with the following official data:

  • Registry property: 5593.
  • Location: Alhucemas Street, S/N, Melilla.
  • Cadastral reference: 4059810WE0045N0001MJ.
  • Ownership: General State Administration, through the State Patrimony.

The publication does not detail the surface area, valuation, or starting price, details which do not appear in the initiation agreement disseminated in the gazette.

Ten Business Days for Allegations

In accordance with Article 138.3 of Law 33/2003, the agreement is made public so that, within a period of ten (10) business days, any party interested in the procedure may present the allegations and documents they deem appropriate, as provided for in Article 82.2 of Law 39/2015, on the Common Administrative Procedure of Public Administrations.

The calculation of the period begins from the publication of the announcement in the Official Gazette of the Autonomous City of Melilla, that is, from October 2, 2026. The initiation of the file does not in itself imply the sale of the property, but rather the opening of the public information phase prior to the resolution of the procedure.

Who Signs and Where it is Published

The agreement is signed by the Delegate of Economy and Finance, José Ignacio Valero Escribano, in Melilla on September 29, 2026, one day after the approval of the initiation.

The text is inserted in the Ministry of Finance section of the bulletin, under the heading of the Delegation of Economy and Finance, State Heritage Section, and occupies page 4942 of issue 6419.

The direct disposal of state assets in Melilla involves the removal of an urban property from the public inventory and its incorporation into the market, with the consequent effect on the surroundings of Alhucemas Street. Interested parties have a limited window of only ten business days to appear and file claims before the Delegation of Economy and Finance resolves the sale.
