Guadalajara begins the prescription of old bonds for 93,055 euros

The Guadalajara City Council has initiated the procedure to declare the statute of limitations on initial bond balances, a recognized obligation for bond refunds, and an ordered payment of non-budgetary items for a total of 93,055.22 euros. The decision was adopted by a resolution dated September 25, 2026, by the Delegated Councilor for Economy and Finance, Alfonso Esteban Señor, and is published in the Official Gazette of the Province of Guadalajara, No. 186, dated September 30, 2026. Interested parties have a period of twenty business days of public information and hearing to submit allegations.

A hearing process of twenty business days

The announcement, issued by the municipal Treasury Service, is based on articles 82 and 83 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, and article 66 d) of Law 58/2003, General Tax Law. The period is counted from the day following the appearance of the announcement in the provincial gazette.

During this period, the file will be available to interested parties at the City Council’s Treasury Service, who may submit allegations or provide documents and vouchers in defense of their rights, proving the performance of actions that may have interrupted the limitation period. Allegations must be submitted at the Registration Office of the Guadalajara City Council or through any of the forms regulated in article 16.4 of Law 39/2015.

Companies, homeowners’ associations, and individuals

The list attached to the announcement includes dozens of bonds pending refund, mostly constituted to guarantee works, occupation of public roads, stalls in fairs and markets, and municipal contracts. Among the highest amounts are:

• PISCINAS POLIFIBRA, S.L.: 17,456.90 euros, for the provisional award guarantee for the construction of two football fields.
• ALCARREÑA Y BONAVAL DE SERVICIOS AUXILIARES S.L.: 6,183.40 euros, for access control and surveillance services.
• GESTION Y PROM.INMOB.MORADA SA: 6,047.00 euros, for the refund of part of the reimbursement for damages from a seized bond.
• PRODUCCIONES MALVHADAS, S.L.: 3,793.20 euros, final bond for the Buero Vallejo theater service.
• ALTAMARCA SA: 3,300.17 euros, for the tender for the provision of physical-sports activities.
• REPRESENTACIONES KARBLA, S.L.: 2,400.00 euros, for the bar-cafeteria of the Palacio Multiusos.
• APLICACIONES EMPRESARIALES CONSULTORIA Y SERVICIOS, S.L.: 2,038.00 euros, for the tender for the computer system for management and access control.
• EDITORIAL PLANETA S.A.: 2,000.00 euros, for 350 copies of the book “Antonio Buero Vallejo. Álbum de dibujos 1925-1931”.

The list also includes homeowners’ associations with bonds for the felling and replacement of trees —CDAD PROPIETARIOS VILLAFONTANA, CDAD PROP CONSTITUCION 31-37 Y AVENIDA DEL EJERCITO 21-25, CDAD P AVENIDA DEL EJERCITO 11 A-B-C-D-E or CDAD P CONSTITUCION 3—, as well as numerous stallholders in the Christmas market of Parque de la Concordia and in the fairgrounds, with amounts that in several cases do not exceed 150 euros. Several operations refer to file 19056/2021.

Accounting cancellation if no one claims

Once the period has elapsed without allegations or the provision of evidence, the Delegated Councilor for Economy and Finance will approve the resolution declaring the prescription, and the recognized obligations and ordered payments will be canceled, with their corresponding removal from the accounting records. The agreement of September 25, 2026, does not constitute notification of a resolution that ends the administrative process: it is a procedural act not subject to appeal, without prejudice to any allegations made within the granted period.

The publication affects companies, homeowners’ associations, and freelancers who hold old unreturned bonds, some established more than two decades ago. Those who do not prove the interruption of the prescription within the deadline will definitively lose the right to claim amounts that, in total, exceed 93,000 euros.
