Govern declara projecte estratègic el nou institut de Vilafranca de Bonany

The Governing Council has declared the construction works of the new Secondary Education Institute (IES) of Vilafranca de Bonany as a general system of public teaching equipment and an autonomous project of special strategic interest (PEIE). The agreement was adopted in the session of October 9, 2026, at the proposal of the Minister of Education and Universities, and is published in the Official Gazette of the Balearic Islands (BOIB) no. 130, of October 13, 2026, under agreement number 10238. The declaration grants full urban planning viability to the land and constitutes the sufficient legal title to segregate the plot and execute the works.

The decision is framed within Article 27 of Law 4/2026, of June 11, on urgent measures to accelerate strategic projects that contribute to the economic transformation of the Balearic Islands and other administrative simplification and rationalization measures. According to this regulation, the PEIE declaration entails the automatic qualification and assignment of the affected land as a general system of public teaching equipment, integrates them by law into the network of public facilities of the municipality, and makes the declaration of general interest on rural land unnecessary.

The Government justifies the measure due to the growing school demand in the area, which necessitates guaranteeing the right to public education and avoiding excessive travel for students. The competence for the creation of public centers corresponds to the Government of the Balearic Islands, while the coordination of educational infrastructures falls to the Ministry of Education and Universities, through the Autonomous Secretariat for Educational Development, in accordance with Decree 10/2025, of July 14.

The land: 10,347.28 square meters on Ermità Agustí Street

The agreement identifies the parameters of the facility and the land subject to the action, which comes from a municipal estate on rural land:

  • Name of the facility: New Secondary Education Institute (IES) of Vilafranca de Bonany.
  • Land ownership: City Council of Vilafranca de Bonany, in the process of transfer to the Autonomous Community of the Balearic Islands.
  • Urban qualification and use: general system of equipment for public educational and teaching use.
  • Location: Ermità Agustí Street, s/n.
  • Net surface area subject to transfer: 10,347.28 m², resulting from the segregation of plot 583 of polygon 2.
  • Original cadastral reference: 07065A002005830000AY, with a total area of 11,008.07 m².

From the original estate, 304.57 m² are excluded for the continuity of the sidewalk of Ermità Agustí Street and the connection of pedestrian traffic, and 356.22 m² corresponding to a three-meter lateral strip intended for a service road, access to the future electrical transformer, and installation of associated infrastructures.

Accelerated processing in the face of rural land restrictions

The case history shows an urban planning deadlock that the PEIE declaration resolves. The original plot is located on rural land, and the municipal architect’s report of September 3, 2026, confirms the technical and legal impossibility of executing an ordinary segregation, as the resulting areas would fall below the minimum cultivation unit. However, the report concludes favorably regarding the division, conditional upon the prior regional action that urbanistically enables the land.

The administrative chronology is as follows:

  • The Vilafranca de Bonany City Council processes municipal file 190/2022 for the availability and transfer of the land.
  • The Municipal Plenary approved the delimitation of the plot destined for educational equipment on June 16, 2026.
  • On August 26, 2026, the request from the Regional Secretariat of Educational Development, signed on August 25, 2026, was received by the council to carry out the segregation procedures.
  • On September 3, 2026, the Mayor issued a decree urging the Ministry of Education and Universities to urgently promote the PEIE declaration before the Governing Council.

What the declaration entails

The agreement consists of six points. In addition to the urban classification and the PEIE declaration, it entrusts the Ministry of Education and Universities and the Vilafranca de Bonany City Council with the promotion and execution of the administrative, technical, cadastral, and registry actions necessary to formalize the segregation, the transfer of the land, and the execution of the works, and orders its publication in the BOIB.

The text recalls that Chapter I of Title V of Law 1/2022, of March 8, on education in the Balearic Islands (BOIB no. 38, of March 17), regulates the network of educational centers and that Article 102 attributes to the Government the creation, suppression, and transformation of public centers. It also invokes the Statute of Autonomy, approved by Organic Law 1/2007, of February 28, regarding the right to education under conditions of equality.

The agreement is signed by the secretary of the Governing Council, Antònia Maria Estarellas Torrens, and by the president, Margarita Prohens Rigo, with an electronic signature date of October 9, 2026.

The declaration responds to a municipal demand and unblocks a pending educational facility, with direct effects on the families and students of Vilafranca de Bonany, who will see the construction of the center and its commissioning accelerated. The automatic classification of the land removes the last known urban planning obstacle and moves the project to the transfer and construction phase.
