Por FactBox Admin

The Governing Council of the Balearic Islands approved on October 9, 2026, the urgent occupation of the lands affected by the expropriation of the “Son Cabaspre road conditioning Project,” corresponding to stage 3 of the Dry Stone Route, in the municipality of Esporles. The agreement, with reference 10237, is published in the Official Gazette of the Balearic Islands (BOIB) no. 130, of October 13, 2026, in Section III, p. 55207. The measure allows for the immediate occupation of 30 estates without waiting for the prior determination of the price.
A 373,443 euro project promoted by the Council of Mallorca
The project is promoted by the Department of Environment, Rural Environment and Sports of the Insular Council of Mallorca, was drafted by TP&E Taller de Projectes, and is signed by the Roads, Canals and Ports engineer Juan Torres Rovira (collegiate no. 12,504). The budget for administrative knowledge is 373,443.12 euros, which includes:
- Execution budget for the contract: 361,817.12 euros.
- Item for expropriations: 4,949.87 euros.
The processing accumulates several precedents: the initial approval resolution of August 8, 2024, the Executive Council agreement of August 14, 2024, which opened the public information period, and the final approval of the project by agreement of the Executive Council on April 1, 2026, published in BOIB no. 54, of April 28, 2026. The Insular Council of Mallorca requested the declaration of urgency through an official letter received on August 3, 2026, and on October 2, 2026, the General Directorate of Coordination and Local Cooperation issued a favorable legal report.
The urgency is justified by the safety of hikers
The declaration is based on a report dated May 23, 2024, ratified by the Resolution of the executive councillor for Environment, Rural Environment and Sports of July 10, 2026, and on article 52.1 of the Law of December 16, 1954, on compulsory expropriation. The main arguments are:
- The lack of signage on the path causes orientation problems, especially with rain or fog, and increases the risk of incidents and accidents.
- The Esporles City Council warned on May 22, 2024, of an increase in lost hikers on this stage, which goes from Son Cabaspre (Esporles) to the Coll de sa Basseta and the Can Boi shelter (Deià), within the GR 221.
- The incorporation of the path into the Dry Stone Route entails its signage in accordance with the Special Plan, a fact considered essential to guarantee the safety of users.
During the public information period, no allegations were submitted, and the Insular Council of Mallorca has adequate and sufficient credit to cover the expenses of the expropriation. The works affecting the bridge over the Can Gira torrent will require authorization from the General Directorate of Water Resources, of the Ministry of the Sea and Water Cycle.

Annex 1 of the agreement details the individualized list of assets, rights, and owners, all within the municipality of Esporles. In total, there are 30 properties and approximately 10,088 m² of expropriation, with the following owners:

Appeal deadlines and signatories
Against the agreement, which exhausts the administrative route, the following may be filed:
- Optional appeal for reversal before the Governing Council within a period of one month, in accordance with Article 124 of Law 39/2015 and Article 57 of Law 3/2003.
- Contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of the Balearic Islands within a period of two months, according to Article 46 of Law 29/1998.
The agreement is signed by the secretary of the Governing Council, Antònia Maria Estarellas Torrens, and the president, Margarita Prohens Rigo.
The decision gives the green light to works that have been pending for more than two years and directly affects owners of rural estates in Esporles, whose lands will be occupied before receiving compensation. For users of the Ruta de Pedra en Sec, the measure is the necessary step for stage 3 to be signposted and become safer for the hikers who traverse it.
