Por FactBox Admin

The City Council of Gomesende has provisionally approved the tax roll for water distribution, including connection fees and the water canon, corresponding to the second four-month period of 2026. The roll consists of 119 users and amounts to 3,350.98 euros, an amount that includes the comprehensive water service, VAT, and the water canon. The resolution was adopted by the Mayor’s Office on September 30, 2026, and is published in the Official Gazette of the Province of Ourense on October 9, 2026, in section IV. Local Entities (official reference: R. 2.342).
A tax roll prepared based on the period from May to August
The tax roll reflects the consumption and connection fees for the period between May 1 and August 31, 2026. The settlement was submitted to the City Council by the company AQUAOURENSE, the concessionaire of the provincial cooperation and assistance service to municipalities regarding the environment and public services related to the hydraulic cycle.
The resolution of the Mayor’s Office, signed by Mayor Pura Rodríguez Álvarez, supports the approval based on the adhesion of the City Council of Gomesende to the Framework Collaboration Agreement regarding the management of subscribers in municipal water cycle services. The agreement further invokes current local and tax regulations:
- Law 7/1985, regulating the bases of the local regime (LBRL).
- Law 58/2003, of December 17, general tax law (LXT).
- Royal Decree 939/2005, approving the General Collection Regulations.
Fifteen days of public exhibition
The approved roll is displayed to the public so that interested parties may submit any claims they deem appropriate. The exhibition is carried out through the publication of an edict in the BOP and on the City Council’s notice board, for a period of 15 days from its publication.
This public exhibition serves as collective notification to all taxpayers, under the terms of article 102.3 of Law 58/2003, of December 17, general tax law. If no claim is submitted, the agreement will be understood as definitively approved.
Two months of collection in the voluntary period
The collection period in the voluntary phase will be 2 months, counted from the day following the publication of the edict in the BOP. Once this period has elapsed, late payment interest and corresponding surcharges will be demanded, in accordance with articles 26 to 28 of Law 58/2003.
Failure to pay the water canon during the voluntary period will result in the demand for payment directly from the taxpayer via enforcement proceedings, under the responsibility of the competent treasury department of the Xunta de Galicia.
Claims and avenues of appeal
Against the settlements incorporated into the roll, and once the public exhibition period has elapsed, interested parties have the following avenues:
- Mandatory appeal for reversal before the mayor, in accordance with article 14.2 of Royal Legislative Decree 2/2004, which approves the revised text of the Law regulating local finances.
- Contentious-administrative appeal before the competent Contentious-Administrative Court, within a period of 2 months from the day following the notification of the resolution of the appeal.
- Economic-administrative claim before the economic-administrative body of the Autonomous Community of Galicia regarding the repercussion of the water canon, within a period of one month from the date the notification is understood to have occurred.
The edict concludes with the date of September 30, 2026, in Gomesende and the signature of the mayor, Pura Rodríguez Álvarez.
The publication of this register directly affects the 119 subscribers to the municipal water service, who must check their settlement during the 15 days of public exhibition and, if no claims are filed, pay the receipt in the following two months to avoid interest, surcharges and, in the case of the water canon, the enforcement procedure.
