Girona puts the bar-restaurant of the Parc del Migdia up for tender for 21,242 euros per year

The Girona City Council has opened a public call to award a temporary occupation license for a public domain space intended for bar-restaurant activity with a terrace in the Parc del Migdia. The agreement was approved by mayoral decree on September 17, 2026, and is available to the public in the Official Gazette of the Province of Girona (BOP) no. 180, of September 18, 2026, in edict 8146 (CVE BOP-2026_0_180_8146, pp. 1-25). The text amends the regulatory bases and increases the minimum annual bidding fee to 21,242.64 euros.
The original bases had been approved by mayoral decree on September 10, 2026, published in BOP no. 176 of September 14, 2026 (CVE BOP-2026_0_176_7998), with a minimum rate of 14,881.51 euros per year. The amendment increases this amount and also updates it in the tenth base, regarding evaluation criteria, and in Annex 6, the economic proposal model. The bidding is governed by Article 57 of Decree 336/1988, of October 17, of the Regulations on the Heritage of Local Entities, and by Article 92 of Law 33/2003, of November 3, on the Heritage of Public Administrations, and is expressly excluded from Law 9/2017 on public sector contracts.
A 350 square meter premises by the lake
The space subject to the license is the interior part of the circular building located in the area surrounding the lake of Parc del Migdia, covered by a semicircular shaded porch, with an approximate surface area of 350 square meters. The current planning classifies it as system C1 of squares, parks, and urban gardens, i.e., a public domain asset, with cadastral reference 5069501DG8456G0001TX.
- Interior useful surface of 373 m²: dining room (73.60 m²), buffet (18.60 m²), bar (106.80 m²), counter (25.20 m²), kitchen (33.80 m²), warehouse (45.90 m²), lobby (18.60 m²), toilets, cold room, and public restroom of 22.80 m².
- Included installations: electricity, gas, smoke extraction of 3,500 m³/hour, air conditioning, and fire protection system.
- Machinery and furniture: gas stove, bain-maries, refrigerators, cold rooms, dishwasher, glasswasher, coffee maker, wine racks, and buffet counter.
- The license includes an outdoor terrace and the obligation to maintain a public and free restroom, open all year round during park hours, including Sundays and holidays.
The reference project is the preliminary project drafted by the team MBM Arquitectes, SA.
Fee, guarantee, and solvency
The minimum annual fee is set at 21,242.64 euros and is considered a tax. Offers must be formulated exclusively upwards and lower amounts will not be accepted; no price review is foreseen. The evaluation criterion is solely economic: 100 points for the highest offer, with the rest scored proportionally.
- Pre-award guarantee: 1.5% of the value of the occupied public domain asset, valued at 645,424.61 euros, which is 9,681.37 euros.
- Civil liability insurance: minimum coverage of 600,000 euros per claim.
- Economic solvency: minimum annual business volume of 500,000 euros.
- Technical solvency: having managed a bar-restaurant with similar characteristics for at least one year within the last three years.
- Penalties for non-compliance: up to 750 euros (minor), 1,500 euros (serious), and 3,000 euros (very serious), with the possibility of license revocation.
Fifteen days to submit offers
The deadline for submitting proposals is 15 calendar days starting from the day after the publication of the announcement on the contracting profile of the Girona City Council. Offers are submitted electronically through the Public Procurement Services Platform, and notifications are made by electronic means via e-NOTUM. If no application is submitted, the procedure will be declared void.
The evaluation commission that will examine the proposals is chaired by the head of the Economic Promotion sub-area, Pepa Lara i Escamilla, and composed of the general secretary of the corporation, the municipal auditor, and the head of the Municipal Facilities Section, Quim Roura. The validity of the license, granted precariously, extends until the award of the public domain concession and, at most, one year from the notification of the award.
The tender opens an opportunity for the catering sector in Girona and, at the same time, responds to a demand from the users of the Parc del Migdia, who will gain a bar service and a free public restroom in one of the city’s most crowded green spaces. The new fee increases the initially fixed rate by more than 6,300 euros per year, thereby also increasing municipal revenues from the private use of public domain.
