Girona puts the bar-restaurant with terrace in the Parc del Migdia out to tender

The Girona City Council has opened the public call to award the license for the temporary occupation of a public domain space in Parc del Migdia, intended for a bar-restaurant activity with a terrace and a free public restroom. The decision, adopted by mayoral decree on September 10, 2026, is published in the Official Gazette of the Province of Girona (no. 176, edict 7998, of September 14, 2026, reference BOP-2026_0_176_7998).

The minimum annual bidding fee is set at €14,881.51, considered as a tax, and offers must be formulated exclusively upwards, with no proposals lower than the minimum rate or price revisions permitted. The deadline for submitting applications is 15 calendar days, counting from the day after the publication of the announcement on the City Council’s contractor profile.

An emblematic space in the heart of the park

The space subject to the license is the interior part of the circular building located in the area surrounding the lake, covered by a semicircular shaded porch, with an approximate area of 350 m². The scope conforms to the preliminary project drafted by the MBM Arquitectes, SA team and includes the provision of installations, furniture, and machinery typical of a bar service, as well as an outdoor terrace space regulated by the Girona Municipal Terrace Ordinance.

The land, classified by current planning as a system of squares, parks, and urban gardens (C1), is a public domain asset with cadastral reference 5069501DG8456G0001TX. The license is granted precariously, with a maximum validity of one year from the notification of the award, and the activity must operate year-round within the park’s opening hours, including Sundays and holidays.

Economic and solvency conditions

To participate, bidders must prove economic and financial solvency with a minimum annual turnover of €500,000 in the best of the last three available fiscal years, and technical solvency consisting of having managed and operated a bar-restaurant with similar characteristics for at least one year within the last three years.

• Guarantee prior to award: €9,681.37 (1.5% of the value of the domain asset, set at €645,424.61).
• Third-party civil liability insurance: minimum coverage of €600,000 per claim.
• Proposals shall be submitted electronically through the Public Procurement Services Platform (contractaciopublica.cat).

Procedure and evaluation

The license will be awarded through a competitive process, in accordance with Article 57 of Decree 336/1988, of October 17 (Regulation of the assets of local entities) and Article 92 of Law 33/2003, of November 3, on the assets of public administrations. The evaluation criterion is based exclusively on the economic offer, with 100 points for the highest fee and proportional scoring for the rest; in the event of a tie, it will be resolved by public draw.

The evaluation commission will be chaired by the head of the Economic Promotion sub-area, Pepa Lara i Escamilla, with the head of the Municipal Facilities Section, Quim Roura, as a member, together with the general secretary and the auditor of the Corporation. The holder must keep the public restroom open to all park users without the requirement of a purchase, comply with terrace regulations, and avoid disturbances to the neighborhood.

The call opens the door to the reactivation of a unique facility in Parc del Migdia, one of the most frequented green spaces in Girona, and directly affects restaurateurs interested in operating a bar-restaurant service with a terrace. For residents and users, the license guarantees a catering service open all year round and a free public restroom, within a framework of public competition that must determine the best fee for the municipal coffers.
