García Puche, nuevo superintendente de Servicios Públicos Domiciliarios por decreto

President Abelardo de la Espriella appointed José Ignacio García Puche to the position of Superintendent, code 0030, grade 25, of the Superintendency of Residential Public Services (SSPD). The decision is recorded in Decree 1583 of 2026, published in the Official Gazette number 53,665 on Wednesday, October 21, 2026, within the decrees section of the National Planning Department. The act repeals the previous appointment, contained in Decree 1339 of August 28, 2026.

An ordinary appointment with immediate effects

The decree was issued based on numeral 13 of article 189 of the Political Constitution and article 2.2.5.1.1 of Decree 1083 of 2015, the regulation governing ordinary appointments in public administration. The text identifies the appointee with citizenship ID number 12625061.

The first article provides for the appointment “as of the date,” meaning with effects from the issuance of the decree. The second article orders that the decision be communicated to José Ignacio García Puche through the Human Talent Directorate of the Superintendency of Residential Public Services, and the third article establishes the validity and the express repeal of Decree 1339 of August 28, 2026.

That previous decree had assigned the same position of Superintendent, code 0030, grade 25, to María Rocío Cortés Vargas, who took office before the Director General of the National Planning Department on August 31, 2026, as recorded in Possession Act 164 of that date. With the new regulation, the assignment is rendered void and the leadership of the office passes to the appointed official.

What the Superintendency monitors

The SSPD is the entity that inspects, monitors, and controls the providers of residential public services for water, sewage, cleaning, electric energy, and combustible gas, according to the competencies assigned to it by the Political Constitution and Law 142 of 1994. Its actions extend to both public and mixed companies as well as private operators serving Colombian households.

Among its most sensitive powers is the ability to order the takeover of provider companies when the grounds of article 59 of Law 142 of 1994 are met, and the ability to appoint, remove, and set the fees of special agents, in accordance with articles 291 and 295 of the Organic Statute of the Financial System and Decree 1369 of 2020. Decisions affecting the continuity of supply in entire regions depend on this power.

The fronts the new superintendent inherits

The office arrives with several open files, all documented in recent editions of the Official Gazette:

  • The takeover of AIR-E S.A.S. E.S.P., ordered by Resolution SSPD 20241000531665 of September 11, 2024, with reported assets of COP 4,400,851 million as of the end of July 2026.
  • The intervention of the Empresa de Acueducto, Alcantarillado y Aseo de Yopal E.I.C.E. E.S.P., with more than 56,661 water subscribers, 46,470 sewage subscribers, and 40,016 sanitation subscribers as of August 2026.
  • The monitoring of emergency and contingency plans due to the orange alert of the Puracé Volcano and the 7.4 magnitude earthquake of August 10, 2026, with its epicenter in San José del Palmar (Chocó).
  • The oversight of compliance with continuity, quality, and coverage goals reported by the providers under its control.

Impact for users

The change of leadership in the Superintendency of Residential Public Services matters to any household that pays a water, energy, or gas bill: that entity is responsible for sanctions against operators, the review of tariffs, and the decision to intervene in companies that cease to provide service. With Decree 1583 of 2026, President Abelardo de la Espriella replaces an acting appointment that had lasted less than two months and hands over the leadership of the organization to José Ignacio García Puche, at a time when the superintendency is managing two high-impact interventions and the monitoring of the country’s seismic and volcanic emergency.
