Fuente el Fresno declares an ex officio expiration of a census registration
Por FactBox Admin

The City Council of Fuente el Fresno has officially declared the expiration of the registration in the Municipal Register of Inhabitants (Padrón) of a non-EU foreign resident without permanent residence authorization who failed to renew their registration within the legal period of two years. This is done through Mayoral Resolution 2026-2279, dated October 22, 2026, published in the Official Gazette of the Province of Ciudad Real number 206, on Monday, October 26, 2026 (announcement number 3448), under case file 2442/2025. The deregistration affects the holder of document Z1726546X and will take effect from the notification or from the publication of the decree in the Official State Gazette.
The legal framework of expiration
The resolution is based on Article 16.1 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, as amended by Organic Law 14/2003, of November 20. This regulation requires non-EU foreigners without permanent residence authorization to renew their registration every two years and declares its expiration when such renewal does not occur.
The decree also invokes the powers of Article 21.1 s) of the same law and Law 39/2015, of October 1, on the Common Administrative Procedure, to establish the effects of the declaration. The case file refers to the deregistration due to the lapse of the two-year period without the renewal being formalized as a foreigner without long-term residence authorization.
A year of procedures and unanswered notices
The announcement details a process that lasted more than a year and in which communications to the interested party were not delivered:
- 10/10/2025: upload and printing of the INE file 13044IA.025.
- 21/11/2025: municipal communication requesting the renewal of the registration (outgoing RC-2448).
- 24 and 27/11/2025: two notification attempts, resulting in “absent during delivery” and a notice left in the mailbox.
- 05/12/2025: return of the notification by the Postal Service with the result “not collected.”
- 22/01/2026: Mayoral order.
- 29/03/2026: verification report from the Local Police, confirming that the person does not reside at the registered address.
- 09/07/2026: report-proposal from the Secretariat regarding the procedure to be followed.
Hearing, notice board, and official publication
Following the Secretariat’s report, the Mayoral Resolution of July 12, 2026, agreed to grant the interested party a hearing for a period of ten days. Notification attempts on July 21 and 23, 2026, failed again, and the shipment was returned on July 31, 2026, with the result “not collected.”
Given the impossibility of personal notification, the City Council resorted to publication:
- 08/27/2026: announcement on the municipal Notice Board, with a publication certificate until 10/02/2026.
- 08/28/2026: announcement in the BOP of Ciudad Real number 165.
- 09/02/2026: announcement in the BOE number 216, with proof of publication until 09/24/2026.
Effects of the resolution and appeals
The agreement provides, in its first point, to declare the census registration expired, effective from the notification or the publication of the decree in the BOE. In the second point, the affected party or their representative is informed that the resolution ends the administrative process and that it may be challenged via:
- Appeal for reversal (recurso de reposición) before the Mayor’s Office-Presidency, within a period of one month.
- Contentious-administrative appeal before the Contentious-Administrative Court of Ciudad Real, within a period of two months.
- Any other appeal deemed appropriate for their legal rights.
The document appears signed in Fuente el Fresno by the Mayor-President and is published in the Local Administration section of the provincial bulletin, with secure verification code 0JpqBZ9qtUbiJaj54i/D.
The ex officio removal from the census is not a minor procedure for the affected party: census registration is the administrative accreditation of residence in the municipality and conditions access to services and benefits linked to registration, in addition to counting toward official population figures. Furthermore, the case shows the usual course of these files when the interested party cannot be located: prior hearing, police verification report, and publication on the notice board, the BOP, and the BOE to guarantee notification.
