Fraga expropia 31 metros de jardines para ampliar la acera del Parque

The Fraga City Council has opened the public information process regarding the list of assets and rights that must be expropriated to widen the sidewalk of Avenida del Parque “28 de marzo”. The agreement was unanimously adopted by the Corporation’s Plenary session on September 24, 2026, and is published in the Official Gazette of the Province of Huesca number 193, dated October 8, 2026, with the official reference BOPH-2026-193006. Affected owners have fifteen days to submit allegations.

The operation is part of file 4643/2026, processed by the Secretariat of the Fraga City Council under the collegiate body number PLN/2026/6. The compulsory expropriation is justified by the execution of the “Valued Report for the Sidewalk Expansion on Avenida del Parque ‘28 de marzo’ in Fraga (Huesca)”, a document drafted by the municipal technical services and valued at 25,913.30 euros.

The Plenary considered the declaration of public utility of the works to be implicit, in accordance with Article 94 of the TRRL and Article 10 of the Compulsory Expropriation Law, and approved the specific, individualized, and valued list of assets to be expropriated. The same body delegated to the Mayor’s Office the determination of the fair price by mutual agreement, an agreement published in the same gazette with the reference BOPH-2026-193005.

Affected assets: 31 square meters and 48 homes

The area subject to expropriation is 31 square meters of privately owned gardens and interior roads belonging to the plot of the social housing blocks named “28 de Marzo”. Since these are common elements of the urban property, the list of affected parties includes all owners of the 48 homes existing in the two blocks:

  • Block at Calle del Parque number 4.
  • Block at Avenida Aragón number 2.

Each home has a share of 2.0833% of the total. The global valuation of the assets and rights amounts to 16,931.10 euros, with individual amounts ranging from 35.27 euros for bare ownerships to 352.73 euros for full ownerships.

Allegations and fair price

Interested parties may submit allegations within fifteen days starting from the day following the insertion of the announcement in the Official Provincial Gazette. The list of assets is available to interested parties on the City Council’s electronic headquarters, http://fraga.sedelectronica.es.

Any natural or legal person may appear to make allegations and provide background information to support corrections in the material and legal description of the assets. Once the agreement is final in the administrative process, the Mayor may set the fair price by mutual agreement if the affected parties accept the municipal valuation.

The processing is based on articles 4.1.d) and 22.ñ of Law 7/1985, articles 23.d, 90, and 94 of Royal Legislative Decree 781/1986, articles 10 and following of the Compulsory Expropriation Law, articles 29.g and 174.2b of Law 7/1999 on Local Administration of Aragon, and articles 333 and 345 of Decree 347/2002 of the Government of Aragon.

Impact on residents

The publication opens the formal period for allegations regarding an expropriation affecting the owners of 48 homes in two official protection blocks in Fraga. Owners can review the valuation assigned to their home, correct errors in the description of the assets, and opt for payment by mutual agreement before the fair price is set.
