Fraga entrusts the Mayor's Office with the awarding of the swimming pool rescue contract

The Mayor’s Office of the Fraga City Council has assumed the competence delegated to the Local Government Board for the award and formalization of the procurement file for the rescue and lifeguarding service and aquatic activities in municipal swimming pools, as well as the indoor sports activities service. The measure, adopted by Decree No. 2026-2964, dated September 3, 2026, is published in the Official Gazette of the Province of Huesca number 170, dated September 7, 2026.

The objective is to expedite the processing of the contract, approved by agreement of the Local Government Board in an extraordinary session on July 31, 2026, because the current contract expires on December 31, 2026, and the new one must be formalized prior to that date.

The assumption of competence

The competence had been delegated to the Local Government Board by Decree number 2023-2334, dated June 23, 2023, for the contracting and granting of all types when the amount exceeds five percent of the ordinary resources of the municipal budget, without exceeding ten percent of the same.

The resolution considers it inconvenient to maintain that delegation for this file, as it does not favor the agility and efficiency necessary for the award within the deadline. The assumption of competence is limited exclusively to the award and formalization of this specific contract.

Regulatory framework

The decision is based on the powers conferred by Article 21.1 of Law 7/85, of April 2, regulating the Bases of Local Regime, and Article 10 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector. It also cites the limits indicated in Article 30.1 of Law 7/99, of April 9, on Local Administration of Aragon, and in Additional Provision II of Law 30/2007, of October 30, on Public Sector Contracts.

Publication and effects

The resolution, signed in Fraga on September 4, 2026, by Mayor José Ignacio Gramún Castillo, provides for its publication in the Official Gazette of the Province and that the Plenary be informed in the first session it holds. However, it takes effect from the day of its signing, in accordance with Article 44 of Royal Decree 2568/1986, of November 28, which approves the Regulation of Organization, Operation, and Legal Regime of Local Entities.

The assumption of competence ensures that the new contract for rescue and lifeguarding at municipal pools and indoor sports activities is formalized before the current one expires on December 31, thus avoiding any interruption in a service essential for the safety of the users of the municipal facilities of Fraga.
