Foz delegates the mayoralty to the second deputy during the vacations

The City Council of Foz has announced the temporary delegation of all Mayoral functions to the second deputy mayor, Ángel Fernández Neira, during the period between September 10 and 17, 2026, both inclusive. The measure, adopted by a Mayoral resolution signed in Foz on September 3, 2026, is due to the mayor’s absence for vacation during that interval, which prevents him from exercising his duties.

The resolution was published in the Official Gazette of the Province of Lugo number 208, Friday, September 11, 2026, in the municipal section, with the official reference R. 2402.

Legal framework of the delegation

The delegation is based on Article 47 of Royal Decree 2568/1986, of November 28, which approves the Regulation on the Organization, Operation and Legal Regime of Local Corporations (ROF). This regulation provides that deputy mayors substitute for the mayor in all of his functions, in the order of their appointment, in cases of absence, illness, or impediment.

The same article establishes that, in these cases, the mayor’s functions cannot be assumed by the corresponding deputy without an express delegation that meets the requirements of Articles 44.1 and 44.2 of the ROF. These precepts require that the delegation be carried out by Mayoral decree and contain, at a minimum, the scope of the matters, the delegated powers, and the specific conditions of their exercise.

Content and effects of the resolution

The resolution provides for the delegation of all Mayoral functions to the second deputy mayor, Ángel Fernández Neira, effective from its signature and during the indicated period. Furthermore, it establishes three communication obligations:

• To notify the second deputy mayor of the resolution.
• To publish the resolution in the Official Gazette of the Province of Lugo.
• To report to the Plenary during the first session to be held.

The resolution was signed by the mayor, Francisco Cajoto Caserío, and attested by the secretary in an accumulation regime, María Luz Balsa Rábade, under Article 3.2 of Royal Decree 128/2018, of March 16.

During the week of September 10 to 17, Ángel Fernández Neira will assume the ordinary management of the City Council of Foz on behalf of the mayor, ensuring administrative continuity and the attention to municipal matters during the mayor’s absence.
