Fonz expropriates 3,720 meters for an emergency perimeter road

The plenary session of the Fonz City Council approved by absolute majority, in an ordinary session held on September 11, 2026, the complementary agreement ratifying the compulsory expropriation of 3,720.99 m² to execute the “Execution Project of the Perimeter Road of the Urban Center of Fonz (Huesca)”. The agreement, signed by Mayor Maria Clusa Planisolis, is published in the Official Gazette of the Province of Huesca number 175, dated September 14, 2026, with reference CSV BOPH-2026-175010 and file 1846074R.

The action responds to the requirement formulated by the General Directorate of Local Administration of the Government of Aragon and aims to provide the upper part of the urban center with a perimeter access that guarantees the arrival of emergency vehicles. The project was initially approved by Mayoral Decree No. 11, dated January 13, 2026, and was included in the Provincial Plan for Economic Cooperation of Works and Services (POS) 2026 of the Provincial Council of Huesca, published in BOPH No. 60, dated March 30, 2026.

An infrastructure for safety and accessibility

The council justifies the urgent occupation based on the need to execute as soon as possible a road that improves communication in the upper area of the municipality and facilitates access for ambulances, fire trucks, civil protection, and other public services. The municipal technical report emphasizes that the work is not a mere ordinary improvement of roads, but an infrastructure linked to the safety of people and property; therefore, the delay of the ordinary procedure would maintain a situation of difficult access to the detriment of the public interest.

The occupation is requested under Article 52 of the Compulsory Expropriation Law and Article 56 of its Regulations, and is considered proportionate as it is limited to the surfaces strictly necessary for the complete and continuous layout of the road.

The affected lands and their valuation

The list of assets and rights, definitively approved as no allegations were presented during the public information period, comprises seven plots within the municipal district of Fonz, with a total value of €5,125.99, including the affection premium:

• Mario Torres Monter, Joaquín Torres Monter, and heirs of Joaquín Torres Marcos (plots 160 and 160, polygon 1): 1,279.06 m², €396.51.
• José Franco Castro and Manuel Matas Boned (plot 163): 261.09 m², €80.94.
• Juan Mazana Lemi (plot 159): 6.57 m², €2.04.
• Plot 245 under investigation/unknown: 610.07 m², €189.12.
• Heirs of Alfredo Sanz Adillón (plot 157): 546.89 m², €1,914.12.
• José M.ª Morancho Castro (plot 155): 1,017.31 m², €2,543.28.

The agreement incorporates the credit retention certificate for the total amount and orders the notification of holders with known addresses, conducting inquiries and, where appropriate, publication by edict for those listed as unknown or under investigation.

Deadlines and appeals

Against the agreement, which concludes the administrative process, interested parties may file a motion for reconsideration before the plenary body within one month, or a contentious-administrative appeal before the Contentious-Administrative Court of Huesca within two months, both counted from the day following the publication of the announcement. The file remains available to interested parties on the municipal electronic office.

The decision by Fonz illustrates how small Aragonese municipalities resort to urgent expropriation to resolve structural accessibility deficiencies. For the residents of the upper part of the urban center, the execution of the perimeter path represents a direct improvement in their safety and the response speed of emergency services, a benefit that the city council considers a priority over ordinary deadlines.
