Flix reopens the file to municipalize water and creates a study commission

The Flix City Council has restarted the procedure to directly assume the management of the water cycle. The Plenary session on September 28, 2026, nullified the initiation agreement approved on March 5, 2026, and once again initiated the file for the implementation and establishment of the drinking water service in the municipality, with the appointment of a study commission responsible for drafting the justifying report. The agreement is published in the Official Gazette of the Province of Tarragona on October 29, 2026 (Edict 52-2026, CVE 2026-10109, pp. 1-2) and is submitted for public consultation.

The text stems from an agreement of the corporation’s Plenary and is processed via article 15.3 of Law 40/2015, of October 1, on the legal regime of the public sector, and Decree 179/1995, of June 13, which approves the Regulation of works, activities, and services of local entities. The publication in the provincial gazette is precisely the step that opens the public consultation, which is also made effective on the corporation’s notice board and the municipal electronic office. The edict is signed by the mayor, Francesc Barbero Escrivà, dated October 27, 2026.

A seven-point agreement replacing that of March 5

The first point of the agreement nullifies the previous initiation, approved by the Plenary on March 5, 2026, and the second restarts the procedure for the implementation and establishment of the drinking water service. In other words, the council is not renouncing municipalization, but rather restarting its processing with a new file and its own study body.

The remaining points close the administrative circuit of the agreement:

• Appoint a study commission for the implementation and establishment of the drinking water service.
• Entrust it with the study, the report, and the formulation of proposals related to the municipalization file of the water service.
• Assign it the preparation of the report referred to in the current regulations.
• Notify the agreement to the interested parties and publish it in the official provincial gazette.

Study Commission: from the mayor to the local fabric

The commission will have a broad composition, with the presence of municipal officials, political groups, and entities and agents from the municipality. The presidency falls to the mayor or the person to whom they delegate, and the secretary is assumed by the corporation’s secretary, who will not have a vote unless the role also falls to a member.

The appointed members are:

• The Councilor for Urban Environment and Public Services.
• The spokespersons of the municipal groups.
• The Head of Municipal Services.
• The president of the Flix Merchants Union.
• The director of the Flix Primary Care Center.
• The representative of Ercros S.A. in Flix.
• The municipal auditing secretary.

The agreement provides that any councilor may participate in the commission as a guest by decision of the body itself.

Remote sessions, consensus and casting vote

The operation of the commission shall comply with articles 15 to 18 of Law 40/2015, with complementary provisions established by the Plenary. Members may attend in person or remotely, but in the latter case, they must notify the presidency and the secretariat at least 24 hours in advance to receive the link to the virtual room.

The commission will meet as often as necessary until the explanatory memorandum can be submitted to the competent collegiate bodies for approval. Agreements on content and wording shall preferably be reached by consensual agreement; if there are discrepancies, the presidency may put the point to a vote, with one vote for the presidency and for each member, and a casting vote for the presidency if the tie persists after a second vote.

With this move, the municipal government formally initiates the municipalization process of the water service, a decision that affects all residents and users of the Flix network. The composition of the commission, which includes citizen entities and the municipality’s main industry, indicates that the discussion on the water management model will be open and public before the Plenary must decide on the substance of the file.
