Faroese probate court opens six-month claim window on Tórshavn estate

The Faroese probate court, Færøernes Skifteret, has opened a six-month claim window on the estate of Rebekka Haker of Tórshavn, requiring every creditor to register and prove their claim before the estate is wound up. The proklama was signed on 25 September 2026 and published in Statstidende on 6 October 2026 under the category Dødsboer · Proklama (Færøerne og Grønland), official reference S01102026-52.

Statstidende is Denmark’s official gazette for legal announcements, published by Civilstyrelsen under the Justitsministeriet. It is the legally recognised channel for proklamas, bankruptcy notices and forced sales, and publication in it is what starts the statutory deadlines. Alongside Danish probate notices, the gazette carries a dedicated category for proklamas issued by the Faroese and Greenlandic authorities, which is how a Tórshavn estate reaches creditors sitting in Copenhagen or Aarhus.

The proklama is the standard instrument used to close the creditor side of an estate: it sets a fixed cut-off, after which claims that have not been notified and documented can no longer be asserted against the estate. The court handling the case is Færøernes Skifteret, the probate division of Retten på Færøerne, based at C. Pløyensgøta 1, FO-100 Tórshavn. The notice states explicitly that “arv og gæld er ikke vedgået” — the estate has not been accepted, meaning no heir has assumed liability for the deceased’s debts.

The estate and the deceased

  • Rebekka Haker, Yviri við Strond 95, FO-100 Tórshavn, Færøerne
  • Born 3 April 1936; died 29 July 2026

What creditors must do

  • Notify and document the claim within six months of the publication date.
  • Calculate the claim as at the date of death, 29 July 2026.
  • Send it to Birita Sandberg Samuelsen, Sókn Advokatar, Jekaragøta 10, FO-100 Tórshavn.
  • Quote the case reference sks.nr. 278/2026.
  • Attach the original documents on which the claim is based.

Six months, not eight weeks

Faroese proklamas run on a markedly longer clock than their Danish counterparts. Danish probate notices published in the same gazette, such as the estate of Dagny Viola Iversen handled by Retten i Herning under case SK-1014/2026-HER, give creditors eight weeks to come forward; the Faroese notice gives six months. The difference matters for anyone comparing deadlines across the two jurisdictions.

The same Tórshavn law firm, Sókn Advokatar, has been named as the claims address in several Faroese proklamas published in recent weeks, including estates with case references sks.nr. 357/2026 and sks.nr. 161/2026. The pattern points to a small, specialised probate bar handling most Faroese estate notices that reach Danish readers through Statstidende.

For creditors in Denmark holding a claim against a Faroese estate, the practical consequence is that the clock runs from publication in Statstidende, not from any Danish deadline. Missing the six-month window means the claim cannot be proved in the estate, and the assets will be distributed without it.
