Falset dissol l'Institut de Cultura i Patrimoni i n'assumeix les funcions

The plenary of the Falset City Council, in an ordinary session on September 28, 2026, approved by absolute majority the dissolution of the Falset Institute of Culture and Heritage (ICP) and the direct assumption of its functions, activities, and services. The agreement, signed by the acting secretary-intervenor Maria Teresa Corzo Munté on September 30, 2026, is published in the Official Gazette of the Province of Tarragona (BOPT) on October 8, 2026, with the official reference CVE 2026-09075.

The agreement is framed within article 85 bis of Law 7/1985, of April 2, regulating the bases of the local regime, and articles 26 and 28 of the ICP Statutes. The text justifies the decision based on the convenience of modifying the management form of the functions, activities, and services developed by the autonomous body, so that they are exercised directly by the council. The file consists of thirteen points and occupies three pages of the provincial gazette.

Direct assumption of functions and services

The second point of the agreement establishes that the functions, activities, and services previously managed by the Falset Institute of Culture and Heritage will be assumed directly by the Falset City Council, within the framework of its competencies and according to the municipal organization to be determined. The measure entails the disappearance of the autonomous body as the cultural governance structure of the municipality.

The council must carry out all administrative, economic, accounting, patrimonial, and organizational actions necessary to make the dissolution and the integration of the ICP into the City Council effective. It must also carry out, if applicable, the communications and registrations before the competent registries, administrations, and bodies.

Liquidation and universal succession of assets

Once the dissolution has been agreed upon, the liquidation of the Falset Institute of Culture and Heritage will proceed to determine and formalize its economic, financial, accounting, patrimonial, and legal situation. The liquidation must identify, among others:

  • Balances and liquid funds.
  • Rights pending collection.
  • Obligations pending payment.
  • Assets and rights.
  • Current contracts and agreements.
  • The status of the assigned personnel.

According to article 28 of the ICP Statutes, the Falset City Council will universally succeed the autonomous body, and its assets will be integrated into the municipal assets. The effects of the dissolution will occur once the planned administrative processing and the actions necessary to make the liquidation, succession, and integration effective are completed.

Agreement with the Centre d’Estudis Falsetans

The plenary also approved the Collaboration Agreement between the Falset City Council and the Centre d’Estudis Falsetans for the maintenance of the municipal museum, incorporated as an annex to the agreement. The agreement provides continuity to that which was signed on September 16, 2013, when the materials from the Centre d’Estudis Falsetans collection were transferred, a delivery that became effective on July 5, 2023.

The objective is to establish the conditions for the conservation, custody, cataloging, study, preservation, and dissemination of these materials and collections once the ICP is dissolved, to guarantee their preservation within the framework of the municipal museum located in the castle of Falset. The text specifies that the formalization of the agreement does not entail the creation of any new autonomous body, consortium, or entity with a separate legal personality.

Joint Commission, public information, and appeals

The agreement appoints the members of the joint monitoring commission, referred to as the Museum Commission:

  • The Mayor of Falset, Carlos Brull Fornt.
  • The Councilor for Culture, Rosa Poy Roda.
  • The Councilor for Finance, Àngels Rocamora Guiu.

The Mayor’s Office is authorized to sign the agreement and to carry out the necessary actions for its formalization and execution. The agreement is subject to public information for 30 days; any allegations submitted will be examined and, if appropriate, resolved by the competent body. Against the agreement, which ends the administrative route, a motion for reconsideration may be filed before the Plenary of the Falset City Council within one month, or a contentious-administrative appeal within two months.

The dissolution of the ICP closes a stage of delegated cultural management in Falset and transfers direct responsibility for the museum, the heritage, and the cultural services of the municipality to the council. Residents should follow the effects of the liquidation and the new agreement to learn how the conservation of the collections and the continuity of cultural activities are implemented.
