Extremadura will pay the 2022 basic and green payments without reductions

The Regional Government of Extremadura (Junta de Extremadura) will pay the basic payment and the green payment for the 2022/2023 campaign without reduction to an Extremaduran farmer, in compliance with judgment no. 117/2026 of the High Court of Justice of Extremadura (TSJEx). The General Directorate of Common Agricultural Policy, under the Ministry of Agriculture, Livestock and Natural Environment, has issued the execution resolution published in the Official Gazette of Extremadura (DOE) no. 182, dated September 21, 2026, with official reference 2026062357.

The origin of the litigation is the resolution of January 18, 2024, from the Director of Common Agricultural Policy of the then Ministry of Agriculture, Livestock and Sustainable Development, which resolved the aid for the basic payment and area-based payment scheme for the 2022/2023 campaign. That resolution was confirmed on appeal by another dated July 30, 2025, which led the interested party to appeal before the Administrative Litigation Chamber of the TSJEx, which processed ordinary procedure no. 556/2025.

The judgment, dated February 20, 2026, upheld the appeal filed by the court representative Mr. Martínez Gutiérrez on behalf and representation of Mr. Antonio Bulnes García, with the Regional Government of Extremadura as the defendant.

The content of the ruling

The ruling revokes the administrative resolution and declares the plaintiff’s right to the correction of their application. Furthermore, it orders the defendant Administration to pay the plaintiff the basic payment and green payment aid for the 2022/2023 campaign without applying any reduction, with costs imposed on the defendant.

The resolution now published orders the full and due effect of that ruling, that is, to execute it in its own terms.

Legal basis for execution

The execution is supported by Article 9.1 of Decree 59/1991, of July 23, which regulates the administrative processing of the execution of judicial resolutions and assigns the head of the competent body the obligation to issue the corresponding resolution to comply with the judgment.

The document was signed in Mérida on September 7, 2026, by the Director General of Common Agricultural Policy, Miguel Antonio Gutiérrez Creus, acting by delegation according to the Resolution of May 11, 2026 (DOE no. 89, of May 12).

In recent weeks, the DOE has published other resolutions for the execution of judgments issued against the Ministry regarding agricultural aid:

• Judgment No. 442/2026, of July 13, of the TSJEx, in ordinary procedure No. 613/2025, promoted by Canto Vichés Titularidad Compartida (DOE No. 176, of September 11, 2026, reference 2026062301).
• Judgment No. 279/2026, of May 5, of the TSJEx, in ordinary procedure No. 290/2025, promoted by ULBASA, SA (NIF A06065734), regarding aid under Decree 87/2024, of June 30 (DOE No. 159, of August 18, 2026, reference 2026062153).

The resolution confirms that the regional Administration must pay the aid in full when the courts annul the applied reductions, a criterion that can be invoked by recipients of basic payment and green payment for the 2022/2023 campaign who have seen their payment reduced in similar terms.
