Expropriations to rehabilitate the road surface of the N-634 between Villamayor and Marcenado

The State Road Demarcation of Asturias has called for the drafting of the records prior to the occupation of the assets and rights affected by the pavement rehabilitation works on the N-634 between Villamayor and Marcenado. The appointment for the owners within the municipal district of Nava will be on October 15, 2026, from 10:00 to 14:00 hours, at the Nava City Council. The announcement is published in the Official Gazette of the Principality of Asturias (BOPA) no. 182, dated September 21, 2026, with official reference 2026-07581.

The expropriation file derives from the approval of the construction project for the work “Surface rehabilitation of the pavement on the N-634 road, from kilometer point 357+550 to 387+887. Section: Villamayor-Marcenado”, with contract key OC-O-26001 and action key 32-O-6240. The General Directorate of Roads approved the project on December 9, 2024, after the layout project was provisionally approved on July 27, 2023, and after the approval of the public information file was resolved on March 12, 2024.

The processing complies with Article 52 of the Compulsory Expropriation Law, modified by Law 11/1996, of December 27, and Article 12.2 of Law 37/2015, of September 29, on Roads, which declares the public utility and the necessity of the occupation of assets for expropriation purposes. The Demarcation Headquarters acts under Article 98 of the LEF and rules 2 and 3 of its Article 52.

Call and Appearance

The holders of the assets and rights being expropriated must appear personally or be represented by a duly authorized person, providing documents proving their ownership and the most recent receipt of the Real Estate Tax (IBI). They may be accompanied, at their own expense, by experts and a notary.

Affected Properties and Owners in Nava

The published list includes properties 0002 to 0011 of the municipality of Nava, with expropriation and temporary occupation areas ranging between 0 and 152 square meters. Among the owners are Fermín Andrés Sastre Ovín, Rufino Ornia Fonseca, Celestino Montequín Río, Monserrat Laiz García (heirs of), the Nava City Council, Julita Vega Hortal, Joaquín Vicente Bernardo Vega, María Jesús Bernardo Vega, José María Arenas García, and Avelina Fernández Ardisana (heirs of). One of the properties, 0011, is listed under Unknown.

Allegations and surface modifications

The announcement warns that modifications have been made to the affected area compared to that contemplated in the layout project, after it was verified that part of the land had already been subject to expropriation for the project “Widening and improvement of the pavement. CN-634 from Santander-Oviedo-La Coruña, p.k. 129.600 to 165.500. Section: Llovio-Infiesto”, key 1-O-287. The plots with cadastral references 33040A107000600000GM and 33040A107000650000GX are included in 33040A107090010000GZ, owned by the State Roads District in Asturias (Ministry S3317008E).

A hearing process is opened for a period of 10 days from the day following the publication of the announcement in the Official State Gazette so that any interested party may make allegations, submit documents, or provide evidence. Furthermore, pursuant to article 56.2 of the Compulsory Expropriation Regulations, until the preliminary reports are drawn up, interested parties may submit written allegations for the sole purpose of correcting possible errors in the list of affected assets.

The appointment will also be communicated via individual summons and the insertion of the announcement in two provincial newspapers and in the Official State Gazette, a publication which, according to article 44 of Law 39/2015, serves as notification to unknown owners or those whose place of notification is unknown. The act directly affects the assets of the owners in Nava, who must attend the appointment on October 15 to determine the value of their assets within the urgent occupation procedure. The announcement was signed in Oviedo on September 10, 2026, by the Chief Engineer of the State Roads District in Asturias.
