The Basque Government has announced three sanctions under the law against sports fraud
Por FactBox Admin

The Directorate of Games and Spectacles of the Department of Security of the Basque Government, headed by Nerea Alday Garate, notified three administrative sanctions on October 23, 2026, under the regulations against violence, racism, xenophobia, and intolerance in the sports arena. The notification was published in the Official Gazette of the Basque Country on November 6, 2026, in issue number 213, with official reference 2026/4705. Three people have been sanctioned, and the resolutions will be inscribed in the Central Registry of Sanctions once they become final in the administrative route.
Three files and the same date of occurrence
The annexes of the announcement include three files. In all three, the date of the events is the same, May 3, 2025, and the resolutions have different dates in the autumn of 2026.
- SV-99-2025-96-D: resolution dated October 5, 2026.
- SV-99-2025-114-D: resolution dated October 2, 2026.
- SV-99-2025-124-D: resolution dated October 2, 2026.
The annexes also include the identity document number of the three interested parties, but the announcement does not specify the type of sanction, the amount, nor the sporting event; these data can be consulted in the file. The three sanctions were issued under the protection of Law 19/2007, of July 11, the law against violence, racism, xenophobia, and intolerance in the sports arena.
In the absence of personal notification
The administration attempted to carry out personal notification, but without result, and therefore published the announcement. The procedure was carried out following the subsidiary route provided for in Article 44 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. As it is a substitute for the usual notification, the announcement itself states that it serves as an individual notification to the interested persons.
The resolutions do not exhaust the administrative route, and the interested parties have a period of one month to file an appeal for reversal before the vice-president of Civil Protection. The period is counted from the day following the publication of the announcement, in accordance with Article 121 and following of the Law 39/2015 regulation. The full text of the resolutions is available at the Directorate of Games and Spectacles, at number 1 Donostia-San Sebastián Street in Vitoria-Gasteiz.
To the central registry, upon becoming final
The registration of the sanctioned individuals is not carried out immediately. As provided in Article 77 of Royal Decree 203/2010, of February 26, which approves the regulation on the prevention of violence, racism, xenophobia, and intolerance in the sports arena, the resolution and the registration data will be sent to the Central Registry of Sanctions after the sanctions become final in the administrative route. In the meantime, the resolutions may be appealed and, therefore, their content may be subject to change.
Autumn sanction department and change of directorate
This notification is not an isolated one. On September 1, in issue number 166 of the Boletín Oficial del País Vasco journal, three other sanctions were notified under reference 2026/3765; their resolutions were dated June 23, June 24, and July 7, 2026, and the date of the events, in those cases as well, was May 3, 2025. On September 2, in issue number 167, the resolution to initiate several new files was published, specifically for file SV-20-2026-44-D, under reference 2026/3771.
It is worth noting that the administrative status of the director who signed the resolutions has changed. On November 3, Decree 183/2026 —published in the same journal on November 6— removed Nerea Alday Garate from the directorate of Games and Spectacles to hold another position in the Department of Security, and the decree took effect on that same day. However, the signature of October 23 was one of the last to process this set of notifications as director.
Impact of the sanctions
The fight against racism and intolerance in sporting events does not end with a single administrative decision: sanctions have a long path from notification to registration in the central registry. In the case of these three instances, almost a year and a half passed between the events and the resolutions, and the appeal periods are still open.
The registration of the sanctioned individuals in the registry is essential so that both state and autonomous community institutions can share this data, and therefore, bans on entering sports facilities or other complementary measures can be effective. Furthermore, the administration had to notify publicly because they were not delivered directly to the interested parties: in this case, the official announcement is the only way to communicate a sanction.
