EU extends Apostolova's Rafah border mission mandate by one month

The Political and Security Committee has extended by one month the mandate of Nataliya Apostolova as Head of Mission of the European Union Border Assistance Mission for the Rafah Crossing Point (EU BAM Rafah), covering the period from 1 October to 31 October 2026. The decision was adopted in Brussels on 22 September 2026 and published in the Official Journal of the European Union, L series, of 24 September 2026 as Political and Security Committee Decision (CFSP) 2026/2157. The extension keeps the head of the EU’s border mission at the Gaza crossing point in place for a further month, beyond the 30 September expiry date set earlier this year.

Who decides and on what legal basis

The decision rests on Article 38, third paragraph, of the Treaty on European Union and on Article 10(1) of Council Joint Action 2005/889/CFSP of 25 November 2005, which established the mission. Under that framework, the Political and Security Committee (PSC) is authorised to take the relevant decisions for the political control and strategic direction of EU BAM Rafah, including the appointment of its Head of Mission.

The preamble records that the High Representative of the Union for Foreign Affairs and Security Policy proposed extending Nataliya Apostolova’s mandate from 1 October 2026 to 31 October 2026. The text states that the one-month extension takes into account information provided by Israel and by the Palestinian Authority.

A mandate renewed month by month

The decision traces a succession of short renewals for the head of the Rafah mission:

• 25 October 2023: PSC Decision (CFSP) 2023/2443 appointed Nataliya Apostolova as Head of Mission from 1 November 2023 to 30 June 2024.
• The PSC subsequently extended her mandate a number of times.
• 25 June 2026: Decision (CFSP) 2026/1458 extended her mandate to 30 September 2026.
• 29 June 2026: Council Decision (CFSP) 2026/1467 amended Joint Action 2005/889/CFSP and extended the mandate of EU BAM Rafah itself from 1 July 2026 to 30 September 2026.
• 22 September 2026: the new decision carries the Head of Mission’s mandate forward to 31 October 2026.

Entry into force and conditions

Under Article 2, the decision enters into force on the date of its adoption, but it applies subject to the adoption of a Council decision extending the validity of Joint Action 2005/889/CFSP beyond 30 September 2026. The instrument was signed for the Political and Security Committee by its Chairperson, L. Mandel Vensild.

The practical effect is that the personal mandate of the Head of Mission is now settled for October, while the underlying legal basis of the mission itself still depends on a separate Council act. Until that act is adopted, the extension of Nataliya Apostolova’s mandate remains conditional.
