The Contentious-Administrative Chamber of the High Court of Justice of the Balearic Islands (TSJIB) has published the notice of the filing of a contentious-administrative appeal against Decree 17/2026, of June 19, which regulates the provision of school canteen and cafeteria services. The notice appears in the Official Gazette of the Balearic Islands (BOIB) no. 125, of October 3, 2026, within Section IV. Judicial Proceedings, page 53902, under number 9931. The appeal is promoted by the Regional Association of Education and Management-Catholic School of the Balearic Islands.

The contested decree was issued on June 19, 2026, and was published in BOIB no. 78, of June 20, 2026, by the Department of Education and Universities of the Government of the Balearic Islands. The regulation governs the school canteen and cafeteria and, at the same time, modifies Decree 30/2023, of May 22, which orders school transport in public educational centers and in special education centers supported by public funds.

What the contested regulation establishes

Decree 17/2026 regulates the provision of school canteen and cafeteria services and introduces changes to Decree 30/2023 on school transport. According to the administrative acts subsequently published in the BOIB, the modification expands the cases in which the right to school transport can be recognized for certain students, specifically under article 2.2.c) of the regulation.

The Department of Education and Universities has already applied this framework: Resolution 9685, published in BOIB no. 122, of September 29, 2026, authorizes the complementary school transport service for students of intermediate and higher vocational training cycles in twenty-eight centers in the Balearic Islands.

Scope of the publication

The publication in the BOIB is carried out in compliance with the Chamber’s ordering diligence and Article 47.1 of Law 29/1998, which provides for the publicity of the filing of the appeal. The announcement identifies the judicial body, the procedure, the parties, and the challenged provision, so that any person with a legitimate interest can become aware of the existence of the litigation.

The appeal affects a rule of direct application in public and chartered educational centers, as the decree regulates the school canteen and cafeteria and modifies the transport regime. The resolution issued by the Contentious-Administrative Chamber of the TSJIB may condition the provision of these complementary services and, therefore, the daily organization of the centers and the families.
