Escariche definitively approves the cemetery tax ordinance and increases fees

The Escariche City Council has definitively approved the Fiscal Ordinance regulating Cemetery services, which sets the price for graves for persons registered in the municipality at 3,500 euros, for non-registered persons at 4,000 euros, and for columbariums at 600 euros. The resolution is published in the BOP of Guadalajara No. 180, corresponding to Tuesday, September 22, 2026, and renders definitive the provisional plenary agreement of the council dated June 11, 2026.

The publication occurs as no claims were filed during the public exhibition period, which automatically makes the initial agreement on the partial modification of the ordinance definitive. The modified text is made public in compliance with Article 17.4 of the Recast Text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5, the regulation that governs the approval procedure for fiscal ordinances of local entities.

The fees of Article 7

The modification affects the tax quota of the ordinance, contained in Article 7 of the approved text. The rates are established at the following amounts:

• Graves for persons registered in the municipality: 3,500.00 euros.
• Graves for persons not registered in the municipality: 4,000.00 euros.
• Columbariums: 600.00 euros.

The 500-euro difference between graves for residents and non-residents introduces a residency criterion into the price of the service, while columbariums, intended for the deposition of cinerary urns, remain in the lowest bracket of the new tariff.

Processing and signing of the agreement

The file begins with the provisional plenary agreement of June 11, 2026, which was subsequently submitted for public information without any allegations or claims being registered within the established period. Once that procedure was completed, the regulation entered into force as the definitive fiscal ordinance of the municipality.

The official announcement was signed in Escariche on September 17, 2026, by the mayor, Raúl García Moratilla, and is disseminated through the electronic headquarters of the Provincial Council with the verification code 586a0c025bd9b92aa27858fc71766a2842db72a2, which allows for the verification of the authenticity of the published document.

Deadlines and means of appeal

Against the agreement of definitive approval, interested parties may file a contentious-administrative appeal, in accordance with Article 19 of the Recast Text of the Law Regulating Local Treasuries. The deadline is two months starting from the day following the publication of the announcement in the Official Provincial Gazette.

The competent body to resolve is the High Court of Justice of Castilla-La Mancha, based in Albacete, as detailed in the municipal announcement itself. The publication in the provincial bulletin therefore constitutes the starting point for the calculation of any challenge.

The entry into force of the new fees directly affects the residents of Escariche and the funeral service companies operating in the town, which must apply the approved amounts in their settlements. As it is a tax ordinance, the published prices are regulated and binding for both the city council and the users of the municipal cemetery, who now have a fixed period to appeal if they consider their interests to be harmed.
