Opponents challenge the rules for 37 firefighter positions

The Gran Canaria Emergency Consortium has summoned all those who may be considered interested parties in the summary procedure 350/2026, which challenges the rules of the call for 37 Firefighter positions. The announcement, registered under number 335052, is published in the Official Gazette of the Province of Las Palmas number 115, corresponding to Friday, September 25, 2026, on page 16519. Applicants and candidates have nine business days to appear in the process as co-defendants.

The procedure is being conducted in Courtroom Number 6 of the Court of First Instance, Contentious-Administrative Section, of Las Palmas de Gran Canaria, and was initiated by Mr. Armando Bailón Quesada. The plaintiff directs his challenge against Decree number 73/2026, of April 6, 2026, by which the optional appeal for reversal filed against rules 6.2.1 and 6.3.5 of the call for the provision of 37 Firefighter positions, published in BOP number 153, of December 22, 2025, was dismissed.

The litigation also extends to the presumed dismissal of the appeal for reversal formulated against Decree number 17/2026, of February 11, 2026, which modifies Annex IV “medical exclusion table” and rectifies rule 6.3.6 “internship period” of the aforementioned rules. The announcement is signed in Las Palmas de Gran Canaria, on September 21, 2026, by the manager of the consortium, Emilio Duch Ramos.

Nine business days to appear

The summons is addressed to all those who may consider themselves interested parties in the administrative file that is the subject of the judicial procedure. The appearance must be formalized in Courtroom Number 3 of the Court of First Instance, Contentious-Administrative Section, of Las Palmas de Gran Canaria, in the capacity of co-defendant.

The period is nine business days starting from the day following the publication of the announcement. The resolution invokes article 49.1 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, in relation to article 45 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

A trickle of litigation in the Consortium

The firefighters’ case is not the only open judicial front within the organization. One week earlier, in BOP number 112, dated September 18, 2026, page 16191, the same consortium summoned those interested in summary proceeding 444/2026, held in court number 3 of the same tribunal.

That other proceeding is promoted by Amador Díaz Rubio, Pedro Gallego Martínez, and Fernando Fernández Díaz against Decree number 48/2024, of May 3, 2024, which approved the Public Employment Offer of the Gran Canaria Emergencies Consortium for the year 2024, and against Decrees number 111/2026, 112/2026, and 113/2026, which dismissed their respective appeals for reversal.

The Gran Canaria Emergencies Consortium is an entity attached to the Insular Council of Gran Canaria, in accordance with article 120 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector, and its management signs the summons published in the provincial bulletin.

Impact for the candidates

The publication opens the period for any person with a legitimate interest in the call for 37 Firefighter positions to join the judicial process and defend their position before a sentence is issued. Those who do not appear within the indicated period will remain outside the proceeding, although the resolution adopted may condition the development and the result of the selection process.
