Interested parties are summoned regarding the appeal for the SES pharmacists' process

Por FactBox Admin

The General Directorate of Human Resources of the Extremadura Health Service (SES) has agreed to summon potential interested parties in the contentious-administrative appeal processed under abbreviated procedure no. 87/2026, so that they may appear before the court within a period of nine days. This is stated in the Resolution of August 17, 2026, published in the Official Gazette of Extremadura this Monday, August 24, 2026, with official reference 2026062169.

The appeal has been filed by Mr. Daniel Nieto Morcillo before the Contentious-Administrative Section of the Court of First Instance, Plaza no. 2, of Mérida, against the Resolution of March 23, 2026, of the SES Management Directorate, which dismissed the administrative appeal filed against the Agreement of the Selection Board of February 26, 2026.

Object of the litigation

The controversy centers on the claims made regarding the questions that make up the examination of the competitive phase of the selection process for access to the status of permanent statutory personnel in the Category of Primary Care Team Pharmacist, within the health institutions of the Extremadura Health Service.

The Selection Board resolved the claims submitted by the candidates on February 26, 2026, and the SES Management Directorate subsequently confirmed that decision by dismissing the administrative appeal on March 23, 2026. The contentious-administrative appeal is now directed against that dismissal.

Deadline and form of appearance

In accordance with Articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, and in compliance with the court’s request, the submission of the administrative file and the summoning of interested parties is agreed upon.

  • The deadline to appear is nine days, counted from the day following the publication of the resolution.
  • Those who appear after the deadline will be considered a party to the proceedings for the steps that have not yet expired.
  • The procedure will continue through its steps without notifications being made in court or of any other kind to those who do not appear.

The resolution, signed in Mérida on August 17, 2026, by the General Director of Human Resources, José Antonio Bote Paz, is published in section III of the bulletin.

Relevance for candidates

The summons directly affects the applicants and other parties interested in the selection process for Primary Care Team Pharmacist of the SES, who may appear before the court of Mérida if they consider that their rights may be affected by the resolution of the appeal. The judicial decision regarding the challenged questions of the competitive examination phase could condition the result of the selection process and, ultimately, the provision of permanent statutory staff positions in the health institutions of Extremadura.
