Por FactBox Admin

The General Directorate of Educational Management of the Government of La Rioja has summoned potential interested parties in ordinary procedure 178/2026, filed before the Contentious-Administrative Chamber of the High Court of Justice of La Rioja against the Ministry of Education and Employment. The summons is formalized through Resolution 40/2026, dated September 29, published in the Official Gazette of La Rioja number 189, dated October 1, 2026, in section III of other provisions and acts, page 16549 (official reference BOR-A-20261001-III–3694).
The procedure arises from two resolutions by the Minister of Education and Employment that dismissed respective administrative appeals filed by the appellant, Eva Sánchez Orive. The Contentious-Administrative Chamber requested the Administration to submit the complete administrative file and to carry out the necessary summons, in compliance with Article 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
The origin of the litigation
The appeal is directed against two administrative acts issued by the Minister of Education and Employment:
- The Resolution of August 3, 2026, which dismisses the administrative appeal of July 22, 2026, filed against the list of selected candidates in the selection process for entry and access to the Teaching Corps.
- The Resolution of August 25, 2026, which dismisses the administrative appeal of July 23, 2026, filed against the List of candidates to hold teaching positions under an interim regime.
Both challenges refer to the processes convened through Resolution 4/2026, of February 4, of the Ministry of Education and Employment of the Government of La Rioja, which covers the corps and specialties subject to the call.
Deadline and effects of the summons
Resolution 40/2026 establishes the conditions for appearing in the process:
- A deadline of 9 business days starting from the day following the publication in the Official Gazette of La Rioja.
- Appearance before the judicial body for those who prove their status as interested parties.
- Warning that, if they do not appear, the procedure will continue without any further notification to them.
- Incorporation of the summons into the administrative file that will be sent to the requesting judicial body.
The document was signed in Logroño on September 29, 2026, by the Director General of Educational Management, Luis Manuel Herce Díez.
Other open judicial fronts
The selection process for the Teaching Corps has accumulated several rulings in contentious-administrative proceedings. Resolution 38/2026, dated September 28, summons in summary procedure 208/2026 before the Court of First Instance, Contentious-Administrative Section, court number 1 of Logroño, also at the request of Eva Sánchez Orive, in this case against the dismissal of the administrative appeal of July 2, 2026, regarding the response from Tribunal number 10 and the Selection Commission for the Early Childhood Education specialty.
In parallel, Resolution 34/2026, dated September 1, from the Directorate General for Educational Management, regulates the internship phase for candidates selected in the procedures convened by Resolution 4/2026, dated February 4.
The summons directly affects the candidates and teachers who participated in the selection process and those appearing on the interim list, as it opens the door for their appearance in a litigation that may condition the result of the selection and the configuration of the interim lists in the community. Interested parties have a brief and peremptory deadline to decide on their appearance before the Contentious-Administrative Chamber of the High Court of Justice of La Rioja.
