The General Directorate of the Civil Service of the Government of the Canary Islands has forwarded to the Court of First Instance, Contentious-Administrative Section of Las Palmas de Gran Canaria, the case file for the appeal filed by María Rosa Santana Cáceres against the termination of employment that followed the execution of Decree 114/2022 on the stabilization of temporary employment. The resolution, dated August 20, 2026, summons all those appearing as interested parties to appear as defendants within nine days. The announcement is published in the Official Gazette of the Canary Islands no. 188, of September 18, 2026, within section V. Announcements, Other announcements.

The origin of the conflict: a termination after stabilization

The resolution of the General Directorate of the Civil Service, under the Ministry of the Presidency, Public Administrations, Justice and Security, responds to a litigation arising from the execution of Decree 114/2022, of May 20, which approved the Extraordinary Public Employment Offer for the stabilization of temporary employment provided for in article 2.1 of Law 20/2021, of December 28, on urgent measures for the reduction of temporality in public employment.

The termination of the plaintiff was agreed upon by Resolution of January 9, 2025, of the General Directorate of the Civil Service, which made public the list of persons selected to enter, through the general system of free access, the Administration Management Corps, General Management Scale (Group A, Subgroup A2), in execution of Annex I of the aforementioned decree. Against this decision, the affected party filed an appeal that was dismissed by administrative silence, which led to the judicial route.

The appeal and the judicial body

The procedure is processed as an abbreviated procedure (PAB) no. 423/2026 before Court No. 1 of the Court of First Instance, Contentious-Administrative Section of Las Palmas de Gran Canaria.

The General Directorate of the Civil Service justifies the publicity of the summons on the grounds that the contested act could affect a plurality of persons to be determined, a case subsumable under article 45.1.a) of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. The action is adopted in accordance with articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.

What is agreed and who may appear

The resolution contains two mandates:

  • Order the referral of the judicialized administrative file corresponding to the contentious-administrative appeal processed as abbreviated procedure no. 423/2026, filed by María Rosa Santana Cáceres.
  • Summon all those appearing as interested parties in the appeal before the Court of First Instance, Contentious-Administrative Section of Las Palmas de Gran Canaria, Plaza no. 1, so that they may appear and be recognized as defendants.

The period for appearance is nine days, counted from the day following the notification of the resolution. The measure affects, in particular, the persons selected in the process for the Management Corps derived from Decree 114/2022, whose expectations of entry could be conditioned by the outcome of the litigation.

The signature and scope of the announcement

The resolution is dated in Santa Cruz de Tenerife on August 20, 2026, and is signed by the Director General of the Civil Service, with delegated signing authority (Resolution no. 157, of October 27, 2023), in the person of the Vice-Minister of Public Administrations and Transparency, Antonio Llorens de la Cruz.

The announcement opens the door for third parties with a legitimate interest in the stabilization process to join as defendants and defend their position before the court rules on the legality of the termination. For the candidates of the Management Corps, the outcome of abbreviated procedure no. 423/2026 may condition the finality of the appointments derived from Decree 114/2022, such that the nine-day period marks the decisive moment to decide on their appearance.
